O-82-984 - 12/9/1982ORDINANCE NO. (/-)A, AN ORDINANCE AUTHORIZING THE CITY ATTORNEY TO PROCEED TO ACQUIRE A SEWER LINE EASEMENT OVER AND ACROSS CERTAIN PROPERTY OWNED BY PREFERRED STAMPING OF TEXAS, INC. WHEREAS, the Council of the City of Round Rock, Texas has determined that certain improvements need to be con- structed to the sanitary sewer system to protect the health and safety of the citizens, and WHEREAS, the City has determined that certain easements need to be acquired on which to construct the needed improve- ments, and WHEREAS, one of the necessary easements is over and across the following described property: FIELD NOTES describing an easement, being a permanent easement fifteen (15) foot in width and a temporary construction easement fifty (50) foot in width, for the purpose of construction and main- tenance of a sanitary sewer line, being upon that certain 2.762 acres conveyed to Preferred Stampings of Texas, Inc., by deed recorded in Volume 540, Page 526, of the Deed Records of Williamson County, Texas, said permanent easement being more parti- cularly described as being seven and one-half (7.50) feet on each side of and adjacent and parallel to its following described centerline and said temporary construction easement being more particularly described as being twenty-five (25) feet on each side of and adjacent and parallel to its following described centerline: BEGINNING FOR REFERENCE at a 60-D nail found in the East line of a 4.00 acre tract of land conveyed to the Protestant Episcopal Church Council of the Diocese of Texas by deed recorded in Volume 674, Page 230, of said Deed Records, being the Northwest corner of said 2.762 acres; thence along the division line between said 4.00 acres and said 2.762 acres S 00°25'10" E, 440.32 feet to a point, being the Westerly limits and POINT OF BEGINNING of the hereinafter described easement centerline; THENCE along the centerline hereof, the following two (2) courses: 1) S 65°28'15" E, 41.39 feet to an angle point hereof; 2) N 84°32'30" E, 158.35 feet to a point in the West right-of-way line of Georgetown Street, a sixty (60) foot wide right-of-way, being an East line of said 2.762 acres, for the Easterly limits and POINT OF TERMINATION of the herein described easement centerline. WHEREAS, negotiations with the owner of the above described tract to purchase an easement have not been success- ful, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS That the City Attorney is hereby authorized to proceed immediately with the acquisition by eminent domain of a sewer line easement over and across the above described property.
