O-82-964 - 8/26/1982ORDINANCE NO. 964 AN ORDINANCE AMENDING CHAPTER 4, SECTION 4.D., CODE OF ORDINANCES, CITY OF ROUND ROCK, TEXAS TO CHANGE THE DATE UTILITY BILLS BECOME DELINQUENT; TO REDUCE THE NOTICE PERIOD BEFORE UTILITIES ARE DISCON- NECTED; TO PROVIDE A FEE FOR HAND DELIVERED NOTICES AND OTHER MINOR TECHNICAL CORRECTIONS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS I. That Chapter 4, Section 4.D. Code of Ordinances, City of Round Rock, Texas is hereby amended to read as follows: D. BILLS (1) Due Date Bills for water, sewer, and garbage collection shall be dated and mailed at such time as may be directed by the City Manager, and payment for such bills is due on or before the tenth (10th) day following the mailing of the bills. (2) Penalty Any bill not paid by the tenth (10th) day following the mailing of the bills shall be deemed past due and a late fee of Two Dollars and Fifty Cents ($2.50) or ten (10%) percent of the total amount due, whichever is more shall be assessed. If it becomes necessary to hand deliver the notice provided for below, an additional fee of $5.00 shall be assessed. (3) Disconnection of Services If a bill continues to be past due for a period in excess of ten (10) days, the water supply to the user shall be shut off and the meter removed. Water service shall not be resumed until all amounts are paid in full, including all fees and a Twenty -Five ($25.00) Dollar meter replacement fee. Replacement meters will be installed up to 5:00 o'clock P.M. of any business day. Any request for replacement of meters received after 5:00 o'clock P.M. will be made on the next business day, except in the case of emergency situations threatening life or health. (4) Notice After a bill has become past due, the City shall mail to the user at his last known address a written notice stating that the bill is presently delinquent and that the user's water supply will be disconnected if the bill and all fees are not paid within ten (10) days of the date the bill became delinquent. A final notice shall be delivered to the users' address on the day before the water supply is to be disconnected. (5) Hearing Any user who has reason to believe that his bill is inaccurate shall have the right to request a hearing before the City's Director of Finance within the aforementioned ten (10) day period. If for any reason the Director of Finance is unable to grant a hearing within that time period, the disconnection of utili- ties shall be delayed until after a hearing is provided. The decision of the Director of Finance concerning the accuracy of any utility bill shall be deemed final. II. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof.
