O-79-724 - 11/20/1979ORDINANCE NO. 7 ?4 AN ORDINANCE ESTABLISHING A CITIZEN ADVISORY COM- MISSION TO ADVISE THE CITY COUNCIL ON ISSUES RELATED TO PROJECTS CONDUCTED WITH EPA ASSIS- TANCE; PROVIDING FOR TERMS OF APPOINTMENT; PROVID- ING FOR QUALIFICATIONS; PROVIDING FOR ELECTION OF A CHAIRMAN; PROVIDING FOR THE FUNCTIONS OF THE COMMISSION; PROVIDING FOR A SECRETARY; PROVIDING FOR MEETINGS; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES. WHEREAS, the regulations of the Environmental Protection Agency (EPA) require the City to establish an advisory group to assist the Council with decision-making responsibility by making recommendations on important issues, and WHEREAS, the membership of this advisory group should reflect a balance of interests of the City of Round Rock, and WHEREAS, the Council wishes to establish such an adviso- ry group, now therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: 101. Creation of Commission There is hereby established a Citizen Advisory Commis- sion, hereinafter called the Commission, consisting of thir- teen (13) members. The members thereof shall be appointed by the city council. 102. Terms of appointment The term of members appointed shall expire on the first day of May, 1980, and thereafter the members shall be appoint- ed for a one year term, expiring on the first day of May of each succeeding year. Vacancies shall be filled for an unex- pired term in the manner in which original appointments are required to be made. Continued absence of any member from regular meetings of the Commission shall, at the discretion of the City Council, render any such member liable to immedi- ate removal from office. 103. Qualification In accordance with the regulations of the EPA the Commis- sion shall consist of substantially equivalent proportion of the following four groups: (a) Private citizens. (b) Representatives of public interest groups. (c) Public officials, and (d) Citizens or representatives of organizations with substantial economic interests in the plan or pro- ject. 104. Chairman of Commission One of the members of the Commission shall be a member of the City Council who shall serve as Chairman of the Commission. 105. Functions of Commission The commission shall act in an advisory capacity only, and shall have no power to bind the city by contract or otherwise. It shall be the function of the Commission to advise and make recommendations to the city council on impor- tant issues related to any projects or activities conducted with EPA financial assistance. In addition, the Commission should encourage a constructive interchange among the various interests present on the Commission and enhance the prospect of community acceptance of action taken on the part of the Commission and city council. Where possible, when conducting its business, the Commis- sion shall be guided by Section 25.7 of part 25 of the EPA regulations concerning public participation in programs under the Resource Conservation and Recovery Act, the Safe Drinking Water Act, and the Clean Water Act. 106. Secretary of Commission The Community Development Coordinator or his representa- tive shall act as secretary of the Commission. He shall act only in an advisory capacity and shall participate in its discussions but shall have no right to vote. He shall be responsible for the day-to-day coordination among the Commis- sion, the city council, and any contractors or consultants. 107. Meetings The commission shall meet at regular intervals with advance notice posted according to the Texas Open Meetings Law. Additionally, meetings may be called upon request of five (5) members, or upon notice from the Community Develop- ment Coordinator that a matter requires the consideration of the Commission. A majority of the members shall constitute a quorum and action taken at a meeting shall require the affirmative vote of a majority of the appointive members in attendance. I1. 201. Savings Clause The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. 202. Repealing Conflict Ordinances All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed.
