ORDINANCE NO. 705
AN ORDINANCE PROVIDING THAT A PORTION OF SAM BASS
ROAD BE VACATED AND ABANDONED; PROVIDING FOR THE
REVERSION OF THE FEE IN SAID LAND; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
THIS ORDINANCE SHALL BECOME EFFECTIVE UPON THE
OPENING OF THE RELOCATED PORTION OF SAM BASS ROAD.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS:
I.
That those portions of Sam Bass Road from the west boundary
line of the west IH 35 frontage road to the east boundary line
of Chisholm Trail Road be and the same is hereby abandoned and
permanently vacated as a street or public thoroughfare of any
kind or character whatever.
II.
That the fee to the land in the above described portions of
said streets and as shown on Exhibit "A" attached hereto is
hereby released and will revert to the adjacent owner as provided
by law, save and except that easements are reserved for any and
all existing utilities.
III.
That all ordinances or parts of ordinances in conflict here-
with are hereby repealed.
IV.
That this ordinance shall take effect and be in full force
and effect from and after the date that the relocated portion of
Sam Bass Road is officially opened for vehicular traffic.

Alternative 1.
By motion duly made, seconded and passed with an affirmative
vote of all the Council members present, the requirement for reading
this ordinance on two separate days was dispensed with.

WHEREAS,, the city of Round Rock, Texas, is considering the
matter of closing and abandoning as a public street that portion
of Sam Bass Road lying between the west boundary line of the I.H. 35
frontage road and the east boundary line of Chisholm Trail Road, and
has given due notice to the property owners whose property abuts on
said area of Sam Bass Road; and,
WHEREAS, it will be to the advantage of the property owners
whose property abuts said portion of said Sam Bass Road being con-
sidered for abandonment and to the advantage of the Public generally
to abandon said portion of Sam Bass Road:
NOW, THEREFORE, in consideration of benefits to be received
by the undersigned and the general public, which are hereby acknow-
ledged, the undersigned, being all of the owners of the property
abutting said area of Sam Bass Road, do hereby fully and forever
release, acquit and discharge the said City, its officers, successors
and assigns, from any and all actions, causes of action, claims and
demands of whatsoever kind or nature on account of the abandonment
and closing of said portion of said Sam Bass Road above mentioned.
It is expressly understood and agreed that this release is
intended as an agreement to the said closing of said portion of said
street and is intended to cover and does cover all damages, losses
and injuries now known or which may become known in the furute, in-
cluding all the effects and consequenced thereof.
