O-78-570 - 10/26/1978ORDINANCE NO. \5/0 AN ORDINANCE PROVIDING FOR THE ADOPTION OF ROBERT'S RULES OF ORDER TO GOVERN PROCEDURE AT COUNCIL MEETINGS; PROVIDING THE CITIZEN WITH AN OPPORTUNITY TO PLACE ITEMS ON THE MEETING AGENDA; PROVIDING FOR PROCEDURE DURING "CITIZENS COMMUNICATIONS;" PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES. WHEREAS, Section 3.11 of the Home Rule Charter for the City of Round Rock, Texas provides that the Council shall establish its own rules and order of business, and WHEREAS, the Council wishes to establish its rules and order of business while assuring that the citizens of the City have a reasonable opportunity to be heard, now therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: Article 1. Rules of Order and Business Section 101. All meetings of the Council shall be conducted in accordance with Robert's Rules of Order, Revised 1915 Edition. Section 102. The City Attorney shall be designated as parlimen- tarian and he shall make rulings on parlimentary procedure when requested to do so by a Council member or when the legality or validity of a Council action might be affected. Article 2. Citizens Communications Section 201. An opportunity for any person to address the Council at any regular meeting shall be provided under an agenda item to be known as "Citizens Communications.' Section 202. No matter brought before the Council during Citizens•: Communications may be acted upon by the Council unless the speci- fic matter appears on the posted agenda as provided by law. Section 203. A. In order for a matter to be placed on the agenda under Citizens_ Communications,a written request therefore shall be filed with the City Secretary no later than seventy-five (75) hours prior to the meeting for which discussion of the matter is requested. B. The written request shall contain the following: 1. A brief, concise statement of the matter to be addressed, 2. The name and address of the person filing the request, 3. The name of the group or organization, if any, that the person is representing, and 4. An estimate of the amount of time required to present the matter. C. Except as authorized by a majority of the Council, each item under Citizens Communications shall be limited to no more than fifteen (15) minutes. Section 205. A. Any person wishing to address the Council concerning a matter not on the agenda under Citizens Communications may do so. B. The City Secretary shall maintain a list for each meeting which shall have a place for the name and address of the person wishing to address the council as well as the subject matter. C. Persons signing the list will be heard after the items placed on the agenda have been heard and in the order they appear on the list. D. After each person who signed the list has been heard, any other person desiring to do so may address the Council. E. Unless authorized by a majority of the Council, persons desiring to address the Council concerning a matter not on the agenda will be limited to no more than five (5) minutes. Article 3. Miscellaneous Section 301. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. Section 302. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. (Mark through the following alternative that is not applicable) Alternative 1.
