AN ORDINANCE CREATING THE SAM BASS HISTORICAL
COMMISSION; PROVIDING FOR THE COMMISSION TO
RECEIVE FUNDS AND GIFTS FROM THE CITY, STATE,
AND FEDERAL SOURCES, AND ALSO FROM PRIVATE
SOURCES; PROVIDING FOR THE COMMISSION TO EXPEND
SAID FUNDS; REQUIRING THAT AN ACCOUNTING BE MADE
TO THE COUNCIL OF THE CITY OF ROUND ROCK;
PROVIDING FOR THE APPOINTMENT OF A FIVE -MEMBER
COMMISSION ONE OF WHICH COMMISSIONERS SHALL
SERVE AS CHAIRMAN; AUTHORIZING SAID COMMISSION
TO APPOINT NON-VOTING ASSOCIATE COMMISSIONERS;
PROVIDING FOR A SAVINGS CLAUSE; PROVIDING FOR
THE EFFECT OF THIS ORDINANCE ON OTHER ORDINANCES
OR RESOLUTIONS.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS:
Section 1. There is hereby created the Sam Bass Historical
Commission.
Section 2. Said commission shall have the power and authority
to receive funds and gifts from the City of Round Rock, the State
of Texas, all Federal sources, and also from private sources.
Section 3. The purpose of said commission shall be to gather,
manufacture, and distribute material of a historical nature, and
provide cultural events related to the history of Round Rock,
Texas, and said commission is hereby given all authority and power
to carry out said purposes.
Section 4. The commission shall have authority to expend
such funds to accomplish the purposes and goals of the commission.
Section 5. The commission shall provide the City Council of
the City of Round Rock with an accounting every
months.
Section 6. The commission shall be composed of a chairman,
and four (4) commissioners who shall be appointed by the City
Council of the City of Round Rock. Said five -member commission
is hereby authorized to appoint non-voting associate commissioners.
Section 7. Provisions shall be made in the annual budget to
provide that Two Thousand Dollars ($2,000.00) will be made
available to the commission to commence its activities.
Section 8. It is hereby declared to be the intention of the
City Council of the City of Round Rock, Texas, that the sentences,
clauses, and phrases of this ordinance shall be severable. If
any of them shall be declared unconstitutional or invalid by the
judgment of any court of competent jurisdiction, it is the intention
of the City Council of the City of Round Rock, Texas, that such
unconstitutionality or invalidity shall not effect any of the
remaining sub -sections, clauses, or phrases of the ordinance.
Section 9. All ordinances, parts of ordinances, or resolutions
in conflict herewith are hereby expressly repealed to the extent
of such conflict.
