O-77-504 - 8/4/1977ORDINANCE NO. 504 An Ordinance conveying a strip of land ap- proximately one foot in width located in the alleyway north of 110 South Mays Street, to CHESTER MADSEN; Providing that the Honorable Mayor of the City of Round Rock, RAY LITTON, execute a Quitclaim Deed to said property in the name of the City of Round Rock conveying said strip of property to CHESTER MADSEN. WHEREAS, LOUIS HENNA has petitioned the City Council of Round Rock, Texas requesting the City to convey to CHESTER MADSEN a one foot (more or less) strip of land from the alleyway north of 110 South Mays Street; and, WHEREAS, the building on the subject property is located ap- proximately one foot over the property line into the City alleyway; and, WHEREAS, tha said encroachment is not interfering with the free and uninterrupted use of said alleyway by the City of Round Rock or the pub- lic; and, WHEREAS, this building has been located on said strip of said alleyway for at least the last twenty-five (25) years; and, WHEREAS, LOUIS HENNA has conveyed the entire property at 110 South Mays Street to CHESTER MADSEN, with a contractual provision obligating LOUIS HENNA to cure this title defect, and the said encroachment in an ob- stacle to the finality of this conveyance; and, WHEREAS, tha City Council deems it advisable to convey said strip of land to CHESTER MADSEN; NOW THEREFORE, BE IT ORDAINED BY the City Council of the City of Round Rock, Texas, that the following described property be conveyed to CHESTER MADSEN, to -wit: SEE EXHIBIT "A" ATTACHED HERETO AND MADE A PERMANENT PART OF THIS INSTRUMENT. HENNA of 305 Taylor, Round Rock, Texas, 78664, and respectfully petitions the City of Round Rock and says: I. That on or about the 17th day of May, 1977, the petitioner had the property surveyed which is located on Lots 1, 2, 3, 4., and the East 16.5 feet of Lot 5, Block 8, original townsite of Round Rock, Wil- liamson County, Texas, with the street address 110 South Mays, Round Rock, and described in Exhibit "A" attached hereto. That said survey was made in compliance with the terms and conditions of a contract to convey the property with a clear title, with intentions of selling the property to MR. CHESTER MADSEN, and that at the time of this survey the building located on said property had been in existance on said property for at least twenty- five (25) years. II. That in the survey as above mentioned and attached as Exhibit "A", it was shown that the building was constructed in such a manner that .8 foot of the Northeast corner and 1 foot -1 inch of the Northwest corner of said building was built within the defined alleyway located directly north of the subject tract. III.
