AN ORDINANCE ESTABLISHING RATES AND BILLING PROCE- DURES FOR WATER, SEWER, AND GARBAGE COLLECTION SERVICES; REQUIRING WATER METERS; PROVIDING FOR INSTALLATION, READING AND TESTING OF WATER METERS; PROVIDING FOR A WATER RATE SCHEDULE; PROVIDING FOR A SEWER RATE SCHEDULE;DEFINING CERTAIN TERMS; PROVIDING FOR A GARBAGE COLLECTION RATE SCHEDULE; PROVIDING PROCEDURE FOR MAILING BILLS; PROVIDING FOR A PENALTY AND DISCONNECTION OF SERVICE FOR DELINQUENT BILLS; REPEALING CERTAIN ORDINANCES; AND PROVIDING FOR A SAVINGS CLAUSE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS. A. WATER Section 1. Meters Required. All premises using the city water supply must be equipped with an adequate water meter fur- nished by the city but paid for by the consumer. Before any premises are occupied, a water meter shall be installed therein as herein required. Any person using the city water supply in violation of this section shall be deemed guilty of a misdemeanor and upon con- viction shall be fined in any sum not exceeding Two Hundred Dol- lars (5200.00) Each day that a violation continues shall be deemed a separate offense. Section 2. Installation. Meters shall be installed in a location that will be easy of access. Section 3. Reading Meters. The Water Superintendent shall read or cause to be read every water meter used in the city at such times as are necessary that the bill may be sent out at the proper time. Section 4. Testing Meters. Any municipal water meter shall be taken out and tested upon complaint of the consumer upon pay- ment of a fee of fifteen dollars ($ 15.00 ) If upon test, the meter is not within three percent ( 37) of being accurate, it shall be repaired or replaced and the fee re- turned to the consumer. Section 5. Water Rates. The rate schedule for users of the city's water works system shall be based on the formula hereinafter set forth. The following schedule of monthly rates or charges for services furnished by the City's Water System shall be and such is hereby adopted and established as follows, to wit: RATES FOR BOTH COMMERCIAL AND RESIDENTIAL USERS Number of Gallons of Water Used 1 - 3,000 Gallons Next 27,000 Gallons Next 970,000 Gallons Use exceeding 1,000,000 Gallons The above water rates apply to all Monthly Water Rates $3.00 (Minimum) .60 per 1,000 .50 per 1,000 .45 per 1,000 gallons gallons gallons users located within the used used used corporate limits of the City. All users located outside of the corporate limits of the City shall pay double the applicable rates charged users within the corporate limits of the City. B. SEWER Section 1. Sewer Rates. The following schedule of monthly rates or charges for services furnished by the City's Sanitary Sewer System shaLl be and such is hereby adopted and established as follows, to -wit: COMMERCIAL USERS Number of Gallons of Water Used 1 - 3,000 Gallons Amounts over 3,000 Gallons Monthly Sewer Rates $4.00 (Minimum) .15 per 1,000 gallons RESIDENTIAL USERS used Number of Gallons Monthly of Water Used Sewer Rates 1 - 3,000 Gallons $2.50 (Minimum) Amounts over 3,000 Gallons .10 per 1,000 gallons used Section 2. Application. The above sewer rates apply to all users located within the corporate limits of the City. All users located outside of the corporate limits of the City shall pay double the minimum charge for the first 3,000 gallons used, but consumption of over 3,000 gallons shall be charged at the same rate as users within the corporate limits of the City. Section 3. Definitions. As used herein, a residential user is :any residence, rent house, duplex or apartment complex in which 2 people reside on a more or less permanent basis. Hotels, motels, and other similar establishments are not to be con- sidered within the definition of residential user. As used herein, a commercial user is any user who operates a business or does not come within the definition of a residential user. Uses which are a combination of commercial and residential uses shall be deemed to be commercial uses. Section 4. Consumption. Monthly water consumption shall be based upon the average monthly water consumption for the months of November, December, January, February, and March of each year. C. GARBAGE COLLECTION Section 1. Collection Rates. The following schedule of monthly rates or charges for the services furnished by the City's Garbage Collection Services shall be and such is hereby adopted and established as follows, to-wit: Classification of User Rates Per Month Residential $ 4.00 General Business 9.00 Light Commercial 15.00 Intermediate Commercial 17.50 Heavy Commercial 25.00 Section 2. Definitions. (a) Residential garbage pick up: Any residence, rent house, duplex or apartment complex in which people do not temporarily reside, is to be considered a residential garbage pick up. Hotels and Motels who serve over-night guests are not considered to be within the definition of a residential garbage pick up. (b) General Business user: All non-residential customers, unless specifically referred to below. (c) Light Commercial user: Service stations, taverns, drug stores, animal clinics and office buildings shall come within the definition of a light commercial user. (d) Intermediate commercial user: Grocery stores (grocery stores containing less than 5,000 square feet would be considered for the purpose of these rates as an Intermediate Commercial User. Those grocery stores in excess of 5,000.00 square feet shall be considered as heavy commercial users as herein- after defined) cafes, restaurants, medical clinics, retirement homes, garages, variety stores, and lumber yards shall come within the definition of an Intermediate Commercial User. (e) Heavy Commercial User: Grocery stores containing in excess of 5,000.00 square feet, schools, manufacturers, hotels, motels, and industries shall come within the definition of a Heavy Commercial User. Section 3. Application. The above garbage collection rates shall apply to all users located within the corporate limits of the City. All users located outside the corporate limits of the City shall pay one and one-half (1 1/2) times the rates set forth above. . BILLS Section 1. Due Date. Bills for water, sewer, and garbage collection shall be dated and mailed at such time as may be di- rected by the City manager, and payment for such bills is due on or before the fifteenth (15th) of each month. Section 2. Penalty. Any bill not paid by the fifteenth (15th) of the month shall be deemed past due and a penalty of 6- $2.50 $2.50 or ten percent (10%) of the total amount due, which ever is more shall be assessed. Section 3. Disconnection of Services. If a bill continues to be past due for a period in excess of thirty (30) days, the water supply to the user shall be shut off and the meter removed. Water service shall not be resumed until all amounts are paid in full, including any penalty and a twenty-five dollar ($25.00) meter replacement fee. Replacement meters will be installed up to 5:00 o'clock p.m. of any business day. Any request for replace- ment of meters received after 5:00 o'clock p.m. will be made on the next business day, except in the case of emergency situa- tions threatening life or health. Section 4. Notice. On or about the first day of the month after which a bill has become past due, the City shall mail to the user at his last known address a written notice stating that the bill is presently past due and that if it continues to be past due for a period in excess of thirty (30) days that the user's water supply will be shut off. This notice is solely for the convenience of the user and whether or not the user receives actual notice shall not affect the duty of the City Manager to cause the water supply to be shut off as provided for herein. E. MISCELLANEOUS All ordinances, resolutions or orders heretofore enacted, passed and adopted by the City Council, or parts thereof, in conflict herewith, are hereby repealed to the extent of the conflict. Ordinances Nos. 220, 221, 221A, 221B, 227, 266 and 267 are hereby specifically repealed. If any section, sub -section or sentence, clause or phrase of this ordinance is for any reason held invalid, such decision or decisions shall not affect the validity of the remaining por- tions of this ordinance.
