An Ordinance vacating the twenty-four (24)
foot roadway easement located along the southern
boundary of Lot 70, Southern Terrace Subdivision of
Round Rock, Texas; Providing that the Honorable May-
or of the City of Round Rock, Texas, RAY LITTON,
execute this ordinance and quitclaim deed in the
name of THE CITY OF ROUND ROCK conveying said road-
way easement to C. A. MCKENZIE, II.
WHEREAS, C. A. MCKENZIE, II, as the owner of Lot 70, South-
ern Terrace Subdivision, has petitioned the CITY COUNCIL OF ROUND ROCK, TEXAS
requesting the City to vacate a twenty-four (24) foot roadway easement over said
lot; and
WHEREAS,the roadway easement has not been used by the CITY OF
ROUND ROCK since its creation; and
WHEREAS the future planning of the area does not include the
existance of a raodway over said roadway easement; and
WHEREAS, the CITY COUNCIL deems it advisable to convey said
alleyway to the respective property owners'
NOW THEREFORE BE IT ORDAINED AS FOLLOWS:
1. It is ORDAINED that the twenty-four (24) foot roadway
easement along the southern boundary of Lot 70, Southern Terr-
ace Subdivision of Round Rock, Texas is hereby vacated; and
2. It is FURTHER ORDAINED that the Honorable Mayor of
the CITY OF ROUND ROCK, RAY LITTON, is hereby instructed to
execute a Quitclaim deed to said roadway easement conveying
said property to C. A. MCKENZIE, II.
All ordinances, resolutions, or orders heretofore enacted, pass-
ed and adopted by the governing body of the CITY OF ROUND ROCK, Texas or parts
thereof in conflict herewith, are hereby repealed to the extent of such conflict.

PETITION TO THE CITY COUNCIL OF ROUND ROCK, TEXAS
REQUESTING THE CITY TO VACATE
CERTAIN PROPERTY TO PETITIONER
TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS:
NOW COMES, C. A. MCKINZIE, II of Round Rock, Williamson County,
Texas by and through his attorney of record, JOHN R. CARTER, and respectfully
petitions the CITY OF ROUND ROCK and says:
I.
That C. A. MCKINZIE, II purchased Lot 70, Southern Terrace Sub-
division to the CITY OF ROUND ROCK, Texas for the purpose of constructing
a dwelling on the property.
II.
That the filed subdivision plat of Southern Terrace Subdivision
shows a twenty-four (24) foot roadway easement on the southern most boundary of
said lot.
III.
That said roadway easement was established for future growth in
the area and has never been used for any purpose and further the plans for the
growth in said area do not include a raodway over said easement.
IV.
That the Department of Planning for the CITY OF ROUND ROCK has
determined that said roadway is not a part of the plan for the area due to the
fact that the adjoining established subdivision has no plans for tying into said
roadway easement.
NOW, THEREFORE, premises considered, the Petitioner respectfully
request that the CITY OF ROUND ROCK, pass an ordinance instructing the
Mayor of Round Rock, Texas, RAY LITTON to vacate said twenty-four (24) foot
raodway easement in the southern most boundary of Lot 70, Southern Terrace
Subdivision and that Mayor RAY LITTON be authorized to execute a quitclaim
deed in the name of the CITY OF ROUND ROCK, TEXAS to said roadway easement to
C. A. MCKENZIE, II.
