O-77-295 - 3/3/1977ORDINANCE NO. An Ordinance vacating the alleyway be- tween lots 1 thru 9, Block 17 and lots 10 thru 15, Block 17 of the original Plat of Round Rock, Williamson County, Texas; Providing that the Honorable Mayor of the City of Round Rock, RAY LITTON, execute this ordinance vacating said property in the name of the City of Round Rock. And execute quitclaim deeds in the name of the City of Round Rock conveying said alleyway to the respective landowners in the name of the City of Round Rock. WHEREAS, MRS. C. D. ANDERSON, et al, has petitioned the City Council of Round Rock, Texas requesting the City to vacate the alleyway north of 620 East Main Street; and WHEREAS, several of the dwellings on the subject property are over the property line into the City alleyway; and WHEREAS said encroachment is not interfering with the free and uninterrupted use of said alleyway by the City of Round Rock Or the public; and, WHEREAS, these building have been located on said alleyway for at least the last twenty-five (25) years; and WHEREAS, MRS. C. D. ANDERSON wishes to convey the entire property at 620 East Main Street to a purchaser and due to said en- croachment she is unable to convey the subject tract; and, WHEREAS, the City Council deems it advisable to vacate said alleyways; and WHEREAS, the City Council deems it advisable to convey said alleyway to the respective property owners; NOW THEREFORE BE IT ORDAINED AS FOLLOWS: 1. It is ORDAINED that the alleyway located between lots 1 thru 9, Bolck 17, and 10 thru 15, Block 17, plat of the origional City of Round Rock, Texas is hereby vacated; and, 2. It is FURTHER ORDAINED that the Honorable Mayor of the City of Round Rock, RAY LITTON, is hereby instructed to execute Quitclaim Deeds to the respective property owners adjoining said alleyway in proportion to their ownership of the adjacent property. All ordinances, resolutions, or orders heretofore enacted, passed and adopted by the governing body of the City of Round Rock, Texas, or parts thereof in conflict herewith, are hereby repealed to the extent of such conflict. 1977. Rosa Westberg, of 4517 Rosedale, Austin, Texas; Mrs. C. D. Anderson, of 602 East Main, Round Rock, Texas, by and through their attorney of record, JOHN R. CARTER, and respectfully petition the City of Round Rock and say, I. That on various dates for the past 75 years, petitioners pur- chased the property located in the 600 block of East Main and East Liberty, Round Rock, Texas; and during the years the petitioners have constructed various out -buildings on said property with said out -buildings being in existence for at least 25 years. II. That at the time these out -building were constructed, they were placed on the property in such a manner that they were located within the defined alleyway located directly north and south of the subject tracts. III. That said outbuildings are into the City alleyway and such encroachments have never and do not now interfere with the alleyway in question and have not been used by the City of Round Rock or the public for more than the past twenty-five (25) years. IV. That said Petitioners discovered said encroachments as a result of a recent survey and such encroachments are placing a cloud on the title of the petitioners thus preventing them from conveying the subject tracts. NOW, THEREFORE, premises considered, the petitioners respect- fully request that the City Council of Round. Rock, Texas pass an ordinance instructing the Mayor of Round Rock, Texas, RAY LITTON, to vacate said alleyway described as a twenty (20) foot strip of land extending the full length of the 600 block between East Main and. Liberty Streets on the rear of lots 1 thru 9, block 17, and 10 thru 15, block 17, plat of the original City of Round. Rock, ER 116 East Main Street Round.
