O-76-292 - 9/27/1976ORDINANCE NO. 4,,,g(M- An Ordinance conveying an eighteen (18) inch strip of land located in the alleyway south of 104 South Mays Street, to LORENZO RUBIO; Pro- fiding that the Honorable Mayor of the City of Round Rock, RAY LITTON, execute a Quitclaim Deed to said property in the name of the City of Round Rock conveying said strip of property to LORENZO RUBIO. WHEREAS, LORENZO RUBIO has petitioned the City Council of Round Rock, Texas requesting the City to convey to him an eighteen (18) inch strip of land from the alleyway south of 104 South Mays Street; and WHEREAS, the dwelling on the subject property is located eight- een (18) inches over the property line into the City alleyway; and WHEREAS said eighteen (18) inch encroachment is not interfering with the free and uninterrupted use of said alleyway by the City of Round Rock on the public; and, WHEREAS, this building has been located on said eighteen (18) inch strip of said alleyway for at least the last twenty-five (25) years; and, WHEREAS, LORENZO RUBIO wishes to convey the entire property at 104 South Mays Street to a purchaser and due to said encroachment he is unable to convey the subject tract; and, WHEREAS, the City Council deems it advisable to convey said eight- een (18) inch strip to LORENZO RUBIO; NOW, THEREFORE, BE IT ORDAINED BY the City of Council of the City of Round Rock, Texas, that the following described property be conveyed to LORENZO RUBIO, to -wit: 4 It is FURTHER RESOLVED that the Honorable Mayor of the City of Round Rock, RAY LITTON is hereby instructed to execute a Quitclaim Deed in the name of the City of Round Rock to LORENZO RUBIO. All ordinances, resolutions, or orders heretofore enacted, passed and adopted by the governing body of the City of Round Rock, Texas, or parts thereof in conflict herewith, are hereby repealed to the extent of such conflict. APPROVED, PASSED AND ADOPTED this the Oday of September, 1976. ATTEST CI r CRETARY MAYOR OF THE CITY OF ROUND ROCK, TEXAS STATE OF TEXAS COUNTY OF WILLIAMSON CITY OF ROUND ROCK 1 X X PETITION TO THE CITY COUNCIL OF ROUND ROCK, TEXAS REQUESTING THE CITY TO DEED CERTAIN PROPERTY TO LORENZO RUBIO TO THE HONORABLE MAYOR AND CITY COUNCIL OF ROUND ROCK, TEXAS: NOW COMES, LORENZO RUBIO of 402 East Main, Round Rock, Texas and respectfully petitions the City of Round Rock and says: I. That on or about the 15thday October, 1976, the petitioner purchased the property located at 104 South Mays, Round Rock, Texas, more completely described on Exhibit "A"attached hereto, from CASEY CASTRO of Round Rock, Texas. At the time of this purchase, the building located on said property had been existance on said property for at least twenty-five (25) years. II. That the time this building was constructed, the building was placed on the property in such a manner that the south eighteen (18) inches of the building were built within the defined alleyway located directly south of the subject tract. III. That said building is and always has been located eighteen (18) inches over on to the City alleyway and such encroachment has never and does not now interfere with the free and uninterrupted use of said alleyway by the City of Round Rock or the public. IV. That the petitioner, LORENZO RUBIO purchased this subject tract without obtaining a survey of said tract and now the petitioner has had a survey made as a condition precedent to a sale of said property and has discovered said eighteen (18) inche encroachment as a result of said survey and such eighteen (18) inch encroachment is placing a cloud on the title of the petitoner thus preventing him from conveying the subject tract. NOW, THEREFORE, premises considered, the petitioner respect- fully requests that the City Council of Round Rock, Texas pass an ordinance instructing the Mayor of Round Rock, Texas, RAY LITTON, to execute a quit- claim deed conveying to LORENZO RUBIO the strip of land described in Exhibit "B" attached hereto.
