O-78-312 - 6/8/1978ORDINANCE NO e /, __ AN ORDINANCE SETTING A SPEED LIMIT OF TWENTY (20)" NILES PER HOUR ON CERTAIN PORTIONS OF DEERFOOT DRIVE AND DOVE HAVEN DRIVE IN THE CITY OF ROUND ROCK; DIRECTING THE CITY MANAGER TO POST APPROPRIATE SIGNS; PROVIDING FOR A PENALTY. WHEREAS, Deerfoot Drive and Dove Haven Drive are the major strees leading to Lake Creek Park and the swimming pool located therein, and WHEREAS, Deerfoot Drive and Dove Haven Drive are heavily traveled, both by automobiles and by children walking and riding bicycles to the park and swimming pool, and WHEREAS, such situation poses a threat to the health, safety, and welfare of the citizens and children of the City of Round Rock, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: Section 1: No person shall drive a vehicle on a street or highway within the corporate limits of the City at a speed greater than is reasonable and prudent under the circumstances then existing. Section 2, Based upon an engineering and traffic investigation and pursuant to, and in accordance with, the provisions of the "Uniform Act Regulating Traffic on Highways" (Vernon's Annotated Civil Statutes, Article 6701(d) the City Council hereby determines and declares that except when a special hazard exists that requires lower spoeds in order to avoid colliding with any person, vehicle or other conveyance on or entering a street or highway, the limits, specified in this section shall be lawful, but any speed in excess of the limits specified in this section shall be prima faire evidence that the speed is not reasonable or prudent and that it si unlawful: (a) The maximum prima faire special limit shall be twenty (20) miles per hour at all times on the following streets: ON FROM TO Deerfoot Drive Burnet Street Entrance to Lake Creek Park Dove. Raven Drive Quail Creek Drive Entrance to Lake Creek Park Section 3: Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor andi upon conviction shall be fined in any sum not to exceed Two Hundred Dollars ($200.00). Section 4: The City Manager of the City of Round Rock, Texas, is hereby directed to erect signs along such streets reflecting the speed limit in accordance with this ordinance. Section 5: All ordinances, and parts thereof in conflict herewith are hereby repealed to the extent of such conflict. READ and APPROVED on first reading this the day of , 1978.
