O-74-251 - 3/7/1974ORDINANCE NO. .G' AN ORDINANCE SETTING FORTH THE PROCEDURES TO BE FOLLOWED BY LAND OWNERS ADJOINING AN UNUSED ALLEY WAY TO SECURE THE VACATING OF AN OLD ALLEY WAY THAT HAS BEEN ABANDONED AS A PASSAGE WAY OR ALLEY FOR AN EXTENDED PERIOD OF TIME: PROVIDING WHAT THE COUNCIL MAY DO WITH THE ALLEY WAY IF IT IS VACATED AND ABAONDED; DECLARING THAT ALL CONFLICT- ING ORDINANCES ARE REPEALED. WHEREAS, there are a number of old alley ways in the City of Round Rock, Texas that have been unused for an extended period of time; and WHEREAS, the said unused alley ways often times constitute a nuisance and health hazard to the adjoining land owners; and WHEREAS, the City Council deems it advisable to set forth certain procedures whereby said adjoining land owners can attempt to secure the vacating of said alley way; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Round Rock as follows: That when two-thirds (2/3rds) of the adjoining land owners to an alley way that has been unused for an extended period of time present a petition to the City Council informing them of such facts, and requesting said alley way be vacated, the City Council at its discretion may or may not vacate and abandon said alley way by proper Ordinance. It is further ordained that the City Council may, upon vacating the said alley way, at its discretion enter into any agree- ment with the said adjoining land owners concerning the use of said property or a possible transfer of title of said property from the City to the said adjoining land owners. All Ordinances, resolutions or orders heretofore enacted, passed and adopted by the governing body of the City of Round Rock, Texas, or parts thereof in conflict herewith, are hereby repealed to the extent of such conflict.
