O-76-291 - 12/9/1976ORDINANCE NO. 9N/ AN ORDINANCE RESTRICTING THE PARKING OF MOTOR VEHICLES, VEHICLES, TRAILERS OR AUTOMOBILES FROM ANY AREA LYING IN THE HIGHWAY RIGHT OF WAY OF U. S. HIGHWAY 79 TO A POINT MARKING THE INTERSEC- TION OF INTERSTATE HIGHWAY 35 AND SAID U. S. HIGH- WAY 79 TO A POINT MARKING THE INTERSECTION OF STATE U. S. 79 AND LOOP 384 (STATE HIGHWAY 81), ALL BEING LOCATED IN THE CORPORATE LIMITS OF THE CITY OF ROUND ROCK, TEXAS; PROVIDING FOR A PENALTY FOR THE VIOLATION OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING FOR A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECT OF CONFLICTING ORDINANCES, RESOLUTIONS, OR ORDERS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: Section 1. It shall hereafter be unlawful for any person to park a motor vehi- cle, vehicle, trailer, or automobile, as those terms are defined by Art. 6675a-1 V. A. T. S. from that area lying in the highway right of way of U. S. 79 beginning at a point marking the intersection of Interstate High- way 35 and said U. S. Highway 79 to a point marking the intersection of U. S. Highway 79 and Loop 384 (State Highway 81), all being located in the corporate limits in the City of Round Rock, Texas. Section 2. Any person convicted of violating any of the provisions of this ordi- nance shall be deemed guilty of a misdemeanor and upon conviction shall be fined in any sum not exceeding Two Hundred Dollars ($200. 00). Section 3. All ordinances, resolutions or orders heretofore enacted, passed, or adopted by the governing body of the City of Round Rock, Texas, or parts thereof, in conflict herewith, are hereby repealed to the extent of such conflict. Section 4. It it hereby declared to be the intention of the City Council of the City of Round Rock, Texas, that the sub -sections, paragraphs, senten- ces, clauses, and phrases of this ordinance shall be severable. If any of them shall be declared unconstitutional or invalid by the valid judgment or decree of any court of competent jurisdiction, it is the intention of the City Council of the City of Round Rock, Texas, that such unconstitutionality or invalidity shall not effect any of the remain- ing sub -sections, paragraphs, sentences, clauses, or phrases of this ordinance. This ordinance would have been enacted by the City Council of the City of Round Rock, Texas, without the incorporation herein of any unconstitutional or invalid sub -sections, paragraphs, sentences, clauses, or phrases.
