O-76-280 - 6/22/1976ORDINANCE NO. 280 AN ORDINANCE ESTABLISHING MINIMUM HEALTH AND HOUSING STANDARDS; PROVIDING FOR AN ENFORCING OFFICIAL; CREATING A BOARD OF HOUSING APPEALS; PROVIDING FOR THE INSPECTION OF DWELLINGS AND PREMISES; PROVIDING FOR SAVINGS CLAUSE; PROVIDING FOR THE EFFECT OF THIS ORDINANCE ON OTHER ORDINANCES OR RESOLUTIONS; PROVIDING FOR PENALTY FOR THE VIOLATION OF THIS ORDINANCE. WHEREAS, the elimination of slums and blighted areas and the prevention of their future growth is a matter of concern to the people of the City of Round Rock, Williamson County, Texas; and WHEREAS, in said city there are dwelling structures which are so dilapidated, unsafe, unhygienic, or unsanitary, as to constitute a menace to the health and safety of the citizens of the City of Round Rock, Texas; and WHEREAS, the City of Round Rock, Texas, has the right and duty to adopt and enforce such health and sanitary regulations as are necessary in order to prevent the spread of disease. NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: Section 1: The Standard Housing Code, 1976 Edition, three (3) copies of which shall be on file in the office of the City Secretary of the City of Round Rock, Texas, is hereby adopted by reference and all regulations, parts, notations, references, and specifications therein are hereby adopted and made a part of this ordinance except as deleted or amended hereafter. Section 2: (a) The office of Housing Enforcing Official is hereby created. (b) The Housing Enforcing Official shall be responsible for the enforcement of this ordinance. (c) The Housing Enforcing Official shall be appointed by the City Manager subject to confirmation of the City Council of the City of Round Rock, Texas. His appointment shall continue during good behavior and satisfactory service. He shall not be removed from office except for cause after full opportunity has been given him to be heard on specific charges. Section 3: (a) There is hereby created a Board of Housing Appeals which shall consist of five (5) members appointed by the mayor subject to the confirma- tion of the City Council. One member shall be appointed to serve one year, two members to serve two years, and two members to serve three years. (b) This Board shall act by majority vote of the members present. (c) Said Board shall have the power and be required to hold public hearings in deciding appeals where it is alleged there is an error in law or fact in any order or decision of the Housing Enforcing Official in the enforcement of this ordinance. Section 4: It shall be the duty of the Housing Enforcing Official to enforce all laws and provisions specified in the Standard Housing Code, 1976 Edition. Section 5: The Housing Enforcing Official, in the discharge of his official duties, and upon proper identification, shall have authority to enter any building, structure, or premises at any reasonable hour. Section 6: Nothing in this ordinance or in the code hereby adopted shall be construed to affect any suit or proceeding now pending in any court, or any rights acquired, or liability incurred, nor any cause or causes of action accrued or existing, under any act or ordinance repealed hereby. Nor shall any right or remedy of any character be lost, impaired or affected by this ordinance. Section 7: Any person violating any of the provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction shall be subject to a fine of not more than Two Hundred and No/100 Dollars ($200.00). Each transaction and violation of any of the provisions hereof shall be deemed a separate offense, and as a separate offense shall be deemed committed on each day during or on which a violation occurs or continues. Section 8: The invalidity of any section or provision of this ordinance or of the code hereby adopted shall not invalidate other sections or provisions thereof. Section 9: All ordinances, parts of ordinances or resolutions in conflict here- with are expressly repealed. READ, PASSED, AND ADOPTED this oW day of June, 1976.
