O-76-271 - 1/15/1976ORDINANCE NO, 271 AN ORDINANCE AMENDING ORDINANCE NO. 269 THAT PROVIDES FOR REGULATION FOR FURNISHING OF WATER AND SEWER SERVICES BY THE CITY OF ROUND ROCK TO RESIDENTIAL AND COMMERCIAL USERS OUTSIDE THE CITY LIMITS, WHICH SAID ORDINANCE WAS PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, ON THE 8TH DAY OF JANUARY, 1976, BY AMENDING SECTION 1 (4) AND SECTION 1 (6) FOR THE PURPOSE OF CLARIFYING THE FURNISHING OF WATER TO SUBDIVISIONS WHICH WERE IN EXISTENCE AT THE TIME THE ORIGINAL ORDINANCE WAS ADOPTED; PROVIDING FOR THE EFFECT OF CONFLICTING ORDINANCES, RESOLUTIONS, OR ORDERS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: Section 1 (4) of the ordinance which provides for regulation of furnishing of water and sewer services by the City of Round Rock to residential and commercial users outside the city limits, passed and adopted by the City Council of the City of Round Rock, Texas, on the 8th day of January, 1976, is hereby amended so that it shall hereafter read as follows: Section 1: (4) New subdivisions (any plat recorded after the date of passage of this ordinance) desiring city water and sewer services shall comply with the subdivision ordinance of the City of Round Rock, Texas, in effect at the time such new subdivision is approved. Existing subdivisions whose plats were recorded with the County Clerk of Williamson County, Texas at the time of the passage of the original ordinance 269 can be furnished with water and sewer services without the necessity of having sanitary sewer collection and treatment facilities. Section 1 (6) of the ordinance which provides for regulation of furnishing of water and sewer services by the City of Round Rock to residential and commercial users outside the city limits, passed and adopted by the City Council of the City of Round Rock, Texas on the 8th day of January, 1976, is hereby amended so that it shall hereafter read as follows: Section 1: (6) Except as provided in Paragraph (4) above, all residential and commercial users shall have sanitary sewer collection and treatment facilities. Water will not be provided to residential and commercial users who utilize septic tanks save and except water can be provided to subdivisions whose plats were recorded with the County Clerk of Williamson County, Texas, at the time original ordinance 269 was adopted. All ordinances, resolutions, or orders heretofore enacted, passed, or adopted by the governing body of the City of Round Rock, Texas, or parts thereof, in conflict herewith, are hereby repealed to the extent of such conflict.
