DE IT ORDAINED BY TEE CITY COUNCIL OF THE CITY OF ROUND ROCK: Section 1: That and agency of the City Council af the City of Round Rock is hereby created which shall be known as the Round Rock Commission,and that such Commission ehail consist of (9) nine members Section 2: Of the original Commission,five (5) members shall be appointed for two (2) year term and the other four (4) members shall be appointed for one year terrns.Thereafter three mernbers shall be appointed during even numbered years and four members shall be appointed during odd numbered year; such appointments to coincide with the terms served by the City Council members. Section That as the terms of officeaf said positions terminate, the City Council shall,as soon as possible,and at any rate within sixty (60) days after such expirations,appoint members to fill such vacancies for a terrn of two years.The Coiancil if interim vacancies occur ehall appoint a successor for the remainder of such term, SECTION 4: The Commission may estaoil5h its own rules as to the attendance of is members to its meetings and,in futherance of such,the Commission may,by a najority votesexpel any member who, in the opinion of the Commissionemisses an unreasonable number of meetings. Section 5: The Commission is hereby empowered to establihs its own Parliamentary procedure;provided that such shall not be in conflict with the law applicable to the Commission or the following: A quorum shall consist of a majority of the entire membership of the Commission and any issue to be voted on shall be resolved by a majority of those present. The Chairman shall be entitled to vote upon any question,but -hall have no veto power. Leetings shall be open to the public and minutes shall kept,and shall be treated as a public record. Section 6: The Commission shall have the power and shall be required to: 1.L'iake,amend,extend and,q..cidto the master plan for the physical development of the City. 2. The Commission shall study plans and plats of proposed sub-, divisions and shall,within legal limitslreccommend that such subdivisions meet with all the standards and requirements as required by the ordinance of the City regulating subdivisions. 3. Draft and recommend to the City Council for its action -an official map of the City and recommend proposed changes in such map. 4. Lake and recommend to the City Council for its action - plans for the clearance and rebuilding of slum districts and blighted areas ;hich may develop within the City, 5. Iake and recommend to the City Council for its action - a zoning plan and recommend changes in such plan. 6. lake and recommend to the City Council for its action - highway facilities and proposed extensions thereof. Review and recommend to the City Council for its action - alterations to existing buildingsplumbingtelectrical and related codes, 8, Leet not less than once each month,meetings to be held at the City Ilalllunless notice of change of meeting place be published in a newspaper of General circulation in the City of,Round Rock. Perform such other functions as may be duly delegated to them from time to time by the City Council. at zuch Round Rock Planning Commission is hereby e an adjunct to the City Council.All administrative 'Section 7: declared t personnel of the City are hereby cooperate with and assist the Harming Commission at all reasonable times. Section 8: Repealing Clause: All ordinances or parts of ordinances thorized and directed to inconsistent with the terms of this ordinance are hereby repealed: provided,however,that such repeal shall be only to the extent of such inconsistency,and in all other resects ti oralnance shi.1I be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance, Sec 9: Savin Clause: If any provision,exception,s-ction, subsection,paragraph,sentence,clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall f eason be held unconstitutional,void or invalid such invalidity shall not affect the validity of the remaining provision s of this ordinance or their application to other persons or sets of circumstances and to this end,all provisions of this ordinance ere declared to be severable. Section 10: Effective Dates: T1s ordinance shall tak effect from and after its passage by the City Council. TEST: STATUTORY PROCEDURE FOR ENACTING A ZONING ORDINANCE 1011 d - PROCEDURE City Council responsible, etc. , PROVIDED, HOWEVER: "no such regulation restriction or boundary shall become effective until: (1) after a public hearing in relation thereto at which parties in interest and citizens shall have an opportunity to be heard at least 15 days notice of the time and place of such hearing shall be published in an official paper, or a paper of general circulation, in such municipality. 1011 f - ZONING COMMISSION To avail itself of zoning power, the City Council shall: (1) (2) appoint commission known as the Zoning Commission which shall recommend the boundaries of the various original districts and regulations for each (3) Zoning Commission shall make a preliminary report and hold public hearings thereon before submitting final report. (4) Legislative body shall not hold its public hearings or take action until it has received the final report of the Zoning Commission PROVIDED - City by ORDINANCE, may provide for holding its public hearing (after notice) jointly with any public hearing held by Zoning Commission BUT - City Council can't take action until receipt of final report of Zoning Commission City Planning Commission may be so appointed
