O-14-207 - 06/15/1914ORDiplAvuE ttEtiULATING THE RUNNING AT LARGE OF DOGS IN THE TOWN OF ROUND ROOK, TEAS AND PrtOVILTNG FOR V1O1,tiT1Oi OF SAID ORDINANCE. BE IT ORDAINED by the Town Oouncil of the Town of Round Rock, Texas, that: - Art. 1.- It shall be the duty of the maybr of the Town of Round Rock, Texas, at any season or time when there are, in his opinion, mad or rabid dogs within or near the city, and the public health or safety is thereby endangered, to issue his proclamation forbidding the running at large of any dogs not muzzled, and he may offer for their destruction such premium as he may deem proper and he may require the elty Marshal to destroy any dog found at large in violation So such proclamation. Art. 2.- A registration fee of One Dollar is hereby levied annually on every dog and bitch owned or harbored within the Town limits of the Town of Round Rock, Texas, and allowed to be registered under the reg- ulation herei n contained. Said registration fee shall be due and payable on the first day of yuly of each year, and it is hereby mage the duty of every owner of any such dog or bitch, or anyone who shall harbor such dog or bitch, to pay over to the mown collector the said fee on or before the first day of duly in each year. Art. 3.- On the tender of the registration fee provided for in article io. 2 the uity and Assessor shall if he be of the opinion that the dog offered for registration is a fit subject therefor under the provisions of this ordinance, furnish the owner or harborer thereof with a metal plate, which shall bear some stamp or number to be determin- ed by the uouncil; and the owner .or }.arborer shall securely fasten same to a °oiler, which shall be worn by the dog or the bitch at all times said anumal shall run at large, except as hereinafter prescribed. Art. 4.- The Town Assessor and uollector shall record in a well bound book kept by him cro r that purpose, a statement concerning each dog registered by him and said statement shall hhow the name, number and sex of the dog registered, the name of the owner or harborer and his place of residence. Art. 5.- It shall be the duty of t iity Marshal to erect a puund suitabAe for he impounding of all dogs, as hereinafter provided, at such place as he may seem suitable which pound shall be under hisecon- trol. It shall also be the duty of the city Marshal to cause all dogs found running at large within the Town limits not wearing a collar and registration tag to be taken and impounded. He shall see to the proper care of all dogs impounded, and shall deliver each impounded dog to it's owner or the purchases thereof, upon an order from the Town Assessor and Collector and the payment of all costa hereinafter provided for. Art. 6.- hereinafter when any dog found on the streets of the Town of Round Rock, Texas, and taken up in accordance with this ordin- ance regarding the impounding of dogs, if so impounded by the city Marshal, thw owner caring to redeem such dog shall in additdon to pro- viding a tag and the payment therefor pay to the Town Assessor and Collector the sum of One Dollar said sum of One Dollar to be paid to the gown marshal for impounding and keeping said dog while so impounded. Art. 7.- Each dog not redeemed by the owner within three full days after the same shall have been impounded shall be allowed to be redeemed upon application of any person who bids therefor the largest sum during the fourth day after such dog has been impounded; provided such sum shall equal or exceed the ^costs accrued against such dog and all dogs not redeemed under the provision hereof within four full days after same shall have been impounded shall be destroyed by the city marshal. The Town Assessor shall pay into the city Treasury the net amount accrueing to the Town all money accrueing under the above provision. Art. 8.- It shall not be lawful for any person to permit any bitch belonging to him to run at large when in heat, and any person violating the provisions of this section shall be deemed guilty of a misdemeanor, and on conviction shall be punished by a fine of not less than five nor more than one riundred Dollars for each offense, and such bitch shall be leable to be impounded in the Town Pound. Art. 9.- It shall not be lawful for any person to keep any dangerous or vicious dog within ;he limits of the town at any time unless the same is kept at all tides securely chained, and no dog or bitch, whether usually dangerous and vicious or not, shall be allowed or permitted by the owner or harborer or otherwise to run at large within the corporate limits of the Town, whether it be in company of the owner or harborer or otherwise between the first day of .uly and the first day of duly each year, unless such dog or bitch shall have been first registered in accordance ith the foregoing regulations. Art. 10.- If any person shall make an affidavit before the Mayor or the Town ulerk that any dog has bitten or attempted to bite any person in the Town, and it shall appear that the person so bitten or attacked was not at the time tresepassing on the personor property fof 'he owner or keeper of the dog, it shall be the duty of the mayor or Clerk to direct the owner or leeper of such'dog to kill the same, or to remove the same permanently from the town limits within six hours from the time of such service or notice. And any person violating any of the provisions of this article shall be deemed guilty of a mis- demeanor, and on conviction shall be punished by a fine of not less than ieive Dollars nor more than one hundred dollars for each and every offense, and each and every day shall constitute a seperate offense. Art. 11. -Any person or persons who shall interfere with the ity marshal or any of his assistants in the discharge of their duties in carting, carrying away or impounding dogs as hereinbefore prescribed, or sha.11 in any manner interfere with the pound or any person in charge thereof, shall be deemed guilty of a misdemeanor,and on conviction shall be fined not less than rive nor more than one ..undyed tioliars.
