WHEREAS, the City of Round Rock has previously entered into an
Agreement for Engineering Services with Chiang, Patel & Yerby, Inc. for
the design of box culverts under R.M. 620 at the Round Rock Hospital, and
WHEREAS, Chiang, Patel & Yerby, Inc. has submitted Supplemental
Agreement No. 4 to the Agreement for Engineering Services for a change
in the scope of services, and
WHEREAS, the City Council desires to enter into said Supplemental
Agreement No. 4 with Chiang, Patel & 'Yerby, Inc . , Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City Supplemental Agreement No. 4 to the Agreement for
Engineering Services with Chiang, Patel & Yerby, Inc . , a copy of same
being attached hereto as Exhibit "A" and incorporated herein for all
purposes .
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

This Supplemental Agreement No 4, to Agreement for Engineering Services is made by and
between the CITY OF ROUND ROCK, TEXAS, hereinafter called the "City" and CHIANG,
PATEL & YERBY, INC., hereinafter called the "Engineer".
WHEREAS, the City and Engineer executed an Agreement for Engineering Services,
hereinafter called the "Agreement", on the 26th day of October, 2000 for the design of box
culverts under RM 620 at the Round Rock Hospital; and
WHEREAS, the City and Engineer executed Supplemental Agreement No. 1 on December 20,
2001 to extend the termination date of the Agreement from December 31, 2001 to June 28, 2002;
and
WHEREAS, the City and Engineer executed Supplemental Agreement No. 2 on July 25, 2002
to extend the termination date of the Agreement from June 28, 2002 to June 30, 2003; and
WHEREAS, the City and Engineer executed Supplemental Agreement No. 3 on July 24, 2003
to extend the termination date of the Agreement from June 30, 2003 to June 30, 2004; and
WHEREAS, it has become necessary to amend the Agreement to modify the provisions for the
scope of services, modify the compensation, and to extend the Agreement;
NOW THEREFORE, premises considered, the City and the Engineer agree that said
Agreement is amended as follows:

II.
Article 3, Contract Period shall be amended as set forth below:
(1) Term. The Engineer is expected to complete the work in accordance with the above
described Work Schedule. If Engineer does not performed the work in accordance with the Work
Schedule, then City shall have the right to terminate this Agreement as set forth below in Article
18. So long as the City elects not to terminate this Agreement, it shall continue from day to day
until such time as the work is completed. Any work performed or costs incurred after the date of
termination shall not be eligible for reimbursement. Engineer shall notify City in writing as soon
as possible if he/she/it determines, or reasonably anticipates, that the work will not be completed
in accordance with the Work Schedule.
(2) Work Schedule. Engineer acknowledges that the Work Schedule is of critical
importance, and agrees to undertake all necessary efforts to expedite the performance of the
work required herein so that construction of the project will be commenced and completed as
scheduled. In this regard, and subject to adjustments in the Work Schedule as provided in Article
2 herein, Engineer shall proceed with sufficient qualified personnel and consultants necessary to
fully and timely accomplish all work required under this Agreement in a professional manner.
III.
Article 4, Compensation and Addendum to Attachment D Fee Schedule shall be amended by
increasing by $21,808.00 the lump sum amount payable under the Agreement for a total of
$143,399.00.
IN WITNESS WHEREOF, the City and the Engineer have executed this Supplemental

SERVICES TO BE PERFORMED BY ENGINEER
The Engineer shall provide the necessary engineering and technical services required for the revisions of
the plans, specifications and estimates (PS&E) for the RM 620 culvert replacement at the Round Rock
Hospital. Additional effort is also required to provide information to the City for their acquisition of ROW
and easements, as well as field locating existing utilities to verify no conflict occurs with the proposed box
culvert. These additional services are described in the TASK OUTLINE shown below.
TASK OUTLINE
I. SURVEYING SERVICES
A. The Engineer shall update Right of Entry contacts to ensure that there is still proper access
required to survey on adjacent properties along the project cooridor.
B. The Engineer shall perform sufficient research for boundary line reconstruction of the affected
tracts.
C. The Engineer will gather limited topographic data for utility"potholes"in the area of the culvert.
Utilities will be uncovered by the City.
II. ROW SERVICES
A. The Engineer will perform sufficient field surveying to recover/re-establish project control points,
boundary markers,and other evidence pertinent to ROW acquisition.
B. The Engineer will determine the location of the existing ROW and existing easements. The
centerline alignment will also be established in the field.
C. The Engineer will prepare descriptions and sketches required by the City for the acquisition of two
ROW parcels(one north and one south of culvert)and one easement(south of culvert).
III. ROADWAY DESIGN SERVICES
A. Title sheet and index of sheets will be revised to show appropriate standards and revised
numbering.
B. Quantities and summaries will be revised based on comments received from TxDOT,as well as
changes due to new design standards.

IV. DRAINAGE DESIGN SERVICES
A. TxDOT SW3P text sheet has been broken into three separate plan sheets and will be incorporated
into the plan set.
B. TxDOT Box Culvert Supplement worksheet is now required for box culvert construction projects.
This worksheet will be prepared and incorporated into the construction plan set.
C. Erosion control plans will be revised to include suggestions made to the City by Fish and Wildlife
Services. This will include a type 3 rock filter dam on the downstream end of the culvert.
D. Culvert layout will be revised to accommodate a thicker wall section on the new TxDOT
standards.
V. SEQUENCE OF WORK AND TRAFFIC CONTROL
A. TCP will be revised based on new TxDOT"Barricade and Construction Standards".
VI. PROJECT MANAGEMENT AND COORDINATION SERVICES
A. The Engineer will download the appropriate updated TxDOT standards for this project. Standards
will be modified and plotted for use in the project.
B. The Engineer will coordinate surveying services with the subconsultant.
C. The Engineer's opinion of probable cost will revised to reflect design changes and bid prices will
be updated to match more with the current rates.
D. The Engineer will attend project coordination meetings,prepare monthly progress reports,and
prepare monthly invoices.

will be prepared for two parcels to be acquired on the both sides of RM 620 (north
and south) as well as for an easement on the south side of RM 620.

Justification: Supplemental Agreement No. 4 is to allow the consultant to change the
scope of services to update plans in accordance with new TxDOT
standard drawings, prepare sketches and exhibits for ROW and easement
acquisition and field survey existing utility locations. The engineer has
agreed to perform the additional work for $21,808.00 bringing the total
compensation for this project to $143,399.00.

Background Information: The City Council approved an engineering contract as
Resolution No. R-00-10-26-13G3 at its regular council
meeting on October 26, 2000 to provide professional
engineering and technical services for the design of box
culverts under R.M. 620 at the Round Rock Hospital.
Supplemental Agreement No. 1 to this contract was
approved on December 20th, 2001, which extended the
contract time until June 28, 2002. Supplemental Agreement
No. 2 extended the contract time until June 30th, 2003,
allowing additional time for coordination with outside
agencies such as the U.S. Fish and Wildlife. Supplemental
Agreement No. 3 extended the contract time until June 30th
2004 so as to continue to coordinate with various agencies
to keep the project moving forward.

A. TxDOT SW3P text sheet has been broken into three separate plan sheets and will be incorporated

B. TxDOT Box Culvert Supplement worksheet is now required for box culvert construction projects.
This worksheet will be prepared and incorporated into the construction plan set.
C. Erosion control plans will be revised to include suggestions made to the City by Fish and Wildlife
Services. This will include a type 3 rock filter dam on the downstream end of the culvert.
D. Culvert layout will be revised to accommodate a thicker wall section on the new TxDOT
standards.
V. SEQUENCE OF WORK AND TRAFFIC CONTROL
A. TCP will be revised based on new TxDOT"Barricade and Construction Standards".
VI. PROJECT MANAGEMENT AND COORDINATION SERVICES
A. The Engineer will download the appropriate updated TxDOT standards for this project. Standards
will be modified and plotted for use in the project.
B. The Engineer will coordinate surveying services with the subconsultant.
C. The Engineer's opinion of probable cost will revised to reflect design changes and bid prices will
be updated to match more with the current rates.
D. The Engineer will attend project coordination meetings,prepare monthly progress reports,and
prepare monthly invoices.

Inland Civil Associates, L.L.C. ( Inland ) is pleased to present its proposal for
Professional Land Surveying Services on the FM 620 Culvert Crossing Project in
Round Rock, TX.
We understand the limits of the project to be from Oakwood Blvd. on the east to
300 feet west of Wyoming Springs Road. Documents for Right-of-Way Acquisition
will be prepared for two parcels to be acquired on the both sides of RM 620 (north
and south) as well as for an easement on the south side of RM 620.
Inland also understands the basic scope of the project to consist of the following:
1) Update Right of Entry contacts,
2) Perform sufficient research for boundary line reconstruction of the affected
tracts.
3) Perform sufficient field surveying to recover/re-establish project control points,
boundary markers, and other evidence pertinent to right-of-way acquisition
products.
4) Location of the existing Right-of-way, existing easements and establishment of
centerline alignment
5) Limited topographic data gathering for utility "potholes" in the area described
above
6) Delivery of a 3D.DGN and 2D.DGN file.
7) Delivery of Parcel Plats and Parcel Descriptions for three parcels.

Basis of Compensation
Inland proposes to perform the above listed services for the EMMATED
Lump Sum Fee of:
Right-of-Way Acquisition and limited topo services: $8,540.00
The estimated fee proposed above are based on personnel time required to perform
the described Scope of Services plus reimbursables. Additional time requirements
resulting from project scope changes, boundary line dispute resolution, plan
revisions, field recovery of or discrepancies of control provided will be considered
reasonable cause for us to seek additional compensation for services not included in
these amounts,
