WHEREAS, §8 . 610 (4) Code of Ordinances (1995 Edition) provides
for the reimbursement for the oversizing of water mains, and
:WHEREAS, Villages at Warner Ranch PUD, L. P. has submitted a
reimbursement request for the oversizing of water mains associated with
the Warner Ranch 1B development (aka Warner Ranch Commercial
Subdivision) , and
WHEREAS, the City Council wishes to approve said reimbursement,
Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the City Council hereby approves of the reimbursement to
Villages at Warner Ranch PUD, L.P. of $2, 104 . 54, which is the cost of
oversizing water mains associated with Warner Ranch 1B development (aka
Warner Ranch Commercial Subdivision) .
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

Our Client,Ed Hamilton,with the Hanover Company would like to request oversize reimbursement applicable
to the completed project referenced above,that was accepted by the City of Round Rock on or about 11/21/03.
Via the letter dated February 12,2004,the City of Round Rock has stated that your staff can recommend
reimbursement for a portion of Waterline`B"that consists of a 12"waterline and is 202.36 linear feet long.
We request a reimbursement for the over-sizing of this line totaling$2,104.54.

Dear Mr.Halden:
On behalf of Villages at Warner Ranch PUD, LP, owner of the above referenced subdivision,
please let this letter serve as verification of the following:
Villages at Warner Ranch PUD, LP installed and paid for the improvements for which
reimbursement is requested. Villages at Warner Ranch PUD,LP has the rights to andis
due any reimbursement for oversizing and has not assigned those rights away to another.
Specifically, the reimbursement due for Warner Ranch Phase 1B Subdivision are calculated as
follows: $2.60 x 4"x 202.36 linear feet=$2,104.54.
Once this request receives the required City Council approval, we ask that the reimbursement be

at Warner Ranch PUD, L.P. for the cost of oversizing water
mains associated with the Warner Ranch 1B development.
(Warner Ranch Commercial Subdivision).

Justification: The developer of Warner Ranch 1B installed 202.36 linear feet of
12-inch water main along the east bound frontage road of SH-45.
According to documentation from the developer's engineer, an 8-
inch main would have been sufficient for the needs of the
development. The main was oversized to a 12-inch to provide
service for future development in the area.
Funding:
Cost: $2,104.54
Source of funds: Oversize Account

Villages at Warner Ranch PUD, LP
Background Information: In addition to the waterline improvements as reflected
in the Preliminary Plat Water and Wastewater Plan,
the City requested as part of the Warner Ranch
Section 1B water system improvements, a 12-inch
line be extended to the farthest western property line.
According to engineering documentation provided at
the time of platting, a 16-inch line bored across the
SH-45 ROW would have been sufficient for the needs
of the development. The 12-inch line was required to
provide water service for future development on the
south side of the SH-45 ROW.
