SUBJECT: City Council Meeting - March 8, 2007
ITEM: 12.A.1. Consider a resolution determining that"Competitive Sealed

Justification:
Effective September 1, 2001, Texas Local Government Code Section 271.113 allows cities to
use certain methods other than competitive bidding in entering into contracts for
construction of facilities. One such method is "Competitive Sealed Proposals." Section
271.114 (a) mandates that the "governing body of an entity that is considering a
construction contract using a method specified by Section 271.113 (a) other than
competitive bidding must, before advertising, determine which method provides the best
value for the government entity." With the existing competitive market staff feels that the
"competitive sealed proposal" would provide the best value for building this project.
