O-2017-4305 - 4/13/2017 ORDINANCE NO. 0-2017-4305 AN ORDINANCE AMENDING CHAPTER 44, CODE OF ORDINANCES (2010 EDITION), CITY OF ROUND ROCK, TEXAS, AMENDING SECTION 44-6 PROHIBITING WATER WASTE; AND PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 44, Section 44-6, Code of Ordinances (2010 Edition), City of Round Rock, Texas, is hereby amended to read as follows: Sec. 44-6. - Prohibiting water waste. (a) It shall be unlawful for a person to engage in any conduct that results in the waste of water from the city's potable and/or reuse water utility systems. (b) Without limiting the foregoing, the following acts constitute the waste of water: (1) It shall be unlawful for a person to fail to repair a controllable leak, including a broken sprinkler head, a leaking valve, leaking or broken pipes, a leaking faucet, or a Bead-that-is-rnistingor leaking toilet. (2) It shall be unlawful for a person to operate, or allow to be operated, an irrigation system with: a. A broken head; b. A head that is out of adjustment where the arc of the spray head is over a street or parking lot; or c. During irrigation, allowing water to run off a property such that there is a trail of water that is running in the street for a distance of 50 feet or greater, or-allowing water to pond in the street or parking lot to a depth greater that one-fourth of an inch, or head(s) that are misting due to high water pressure. (3) It shall be unlawful for a person to operate, or allow to be operated a fountain or decorative water feature unless a recirculation device is in use. Ill. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. 0112 1704 00374264 B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. ,,A p� AREAD and APPROVED on first reading this the V9J day of Iy1llwl-� 12017.
