G-07-04-26-11A1 - 4/26/2007 ORDINANCE NO. -- AN ORDINANCE AMENDING THE CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, CHAPTER 1, SECTION 1.1902 AMENDING THE LIBRARY CARD FEE SCHEDULE TO ALLOW FOR A LIMITED SEASONAL CARD AT A REDUCED RATE FOR CERTAIN NON-RESIDENTS, AND PROVIDING AN EFFECTIVE DATE, A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, the City of Round Rock Public Library wishes to provide for a one-time seasonal variance in its card fee schedule for certain non-residents, and WHEREAS, the City of Round Rock and the Round Rock Independent School District wish to gauge the response of the affected demographic to help determine the feasibility of a joint use facility project, and WHEREAS, providing for a temporary amendment of the Code provisions directing the level of card fees and services available to non-residents will set a benchmark for determining the probable impact a joint use facility will have on the City Library and the Round Rock Independent School District, Now Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 1, Section 1. 1902 (2) Code of Ordinances (1995 Edition) , City of Round Rock, Texas, is hereby amended to read as follows: (2) Library Card Fee (a) No library card fee shall be charged to a resident of the city or to a non-resident who owns real property within the city according to the records maintained by ®PFDesktop\::ODNA/WORLDOX/O:/WDOX/ORDINANC/070426A1.WPD/ps the city tax office, provided that the non-resident also has no delinquent property taxes due at the time the card is issued. (b) No library card fee shall be charged to a non-resident full time employee of the City of Round Rock. (c) TexShare Cardholders No library card fee shall be charged for participants in the TexShare Card System, established under the Texas Government Code, Chapter 441. Libraries and Archives, Subchapter M. Texshare Library Consortium. (d) Except as otherwise provided, all other non-residents shall be charged an annual non-refundable library card fee of twenty-five ($25.00) dollars per person or forty ($40.00) dollars per family for the issuance of a library card. (e) The library card fee shall be waived for persons who reside within the Round Rock Independent School District (RRISD) and meet the requirements for the National School Lunch Program, as set out in Title 7 of the Code of Federal Regulations, Part 210. (f) Waiver and Reduced Cost for Non-Resident Fees for Library Services Provided May 26 through August 11, 2007 (i) This subsection applies only to children aged 5-18 years who live outside of the corporate city limits of Round Rock, but within the Round Rock Independent School District and will be attending a Round Rock Independent School District school in the fall of 2007. (ii) Persons covered by this subsection are eligible to obtain a library card for use from May 26 though August 11, 2007 according to the following choices: (A) Free Card: Holder is limited to 5 checked out items at any one time. Holder may not participate in summer reading program awards and prizes. The card is only valid between May 26 and August 11, 2007. (B) $7.00 Card: Holder is entitled to make use of the complete range of library services between the dates of May 26 through August 11, 2007. This subsection (f) will expire by operation of law at the end of the day on August 11, 2007. Upon its expiration, the requirements pertaining to library card fees will revert back to the provisions contained in subsections (a) through (e). II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. 2 C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider an ordinance adjusting non-resident fees for library services to RRISD students in the form of a temporary card from May 26-August 31, 2007. (First Reading) Department: Library Staff Person: Dale Ricklefs, Library Director Justification: The Round Rock Public Library System (RRPLS) and the Round Rock Independent School District (RRISD) are discussing a joint branch/school library at the fifth high school on Gattis School Road. The RRPLS, in anticipation of this relationship, recommends that a pilot project be initiated this summer to gauge the impact of non-resident school-aged children's use on the library's services and collection through a free and reduced fee program. It recommends that two forms of alternative cards be offered to children entering the RRISD for use between May 26 and August 31, 2007. Free card: The free card will entitle the student to 5 items, excluding the DVD collection, during the dates mentioned above. The card does not provide access to the summer reading program contest. Reduced fee card: The second service includes a $7.00 card for the dates listed above. This card provides complete service to the library's collection and the entire summer reading program contest. Financial impact: It is estimated that there will be a reduction of $2800 in non-resident fee revenue and an 8% increase in the number of items checked out. The staff of the library feels that as these children do not have access to a library during this period of time, that the Round Rock Public Library System should provide some options for these children to maintain reading and learning skills during the summer months. The reduced non-resident fee will help fund core staffing required to meet expected demand of those checking out a larger number of items and attendance at the concluding party. This is a pilot program to assess library use and to gauge impact of service cost and possible loss of revenue when a co-located RRPLS/RRISD branch opens in 2009 or 2010.
