AN ORDINANCE CHANGING THE NAME OF A PORTION OF KIPHEN ROAD, AS SHOWN ON EXHIBIT -A-, TO OLD SETTLERS BOULEVARD; PROVIDING A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That the name of the roadway now known as Kiphen Road, as shown on Exhibit "A" , is hereby changed to Old Settlers Boulevard. II. All references to this street name in The Code of Ordinances (1995 Edition) , City of Round Rock, Texas, are hereby amended to reflect said change. III. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, O:\vAbxX RD@IANM7o6290.W1Yh considered and formally acted upon, all as required by the open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider an ordinance changing the name of Kiphen Road to Old Settlers Boulevard. (First Reading) Department: Planning and Community Development Staff Person: Jim Stendebach, Planning and Community Development Director Justification In August 2000, the City annexed Kiphen Road, from FM 1460 to CR 122, to prepare for future annexations and improvements to Kiphen Road. Roadway improvements began in August 2004, and construction on the first phase will be complete later this summer, with phase two expected to be complete in the spring of 2008. 'The Planning Department had intended to rename this improved section of Kiphen Road upon completion of construction. However, with the addition of a new zip code by the USPS, those businesses and residents would have to endure two address changes within the span of a year. We believe it is important we make the name change to the roadway effective in time that it will prevent property and business owners from having to go through two address changes, one for the zip code and one for the street name. This street name change furthers the City's efforts to maintain consistent street naming throughout Round Rock. Fundina: Cost: N/A Source of funds: N/A Outside Resources: N/A Backaround Information: According to the requirements of City Council Resolution No. R-02-11-26-10C1, the following has been completed: On July 28, 2006, written notices were sent to the property owners of the land adjacent to Kiphen Road ROW. By mid-September the city had received return approval from 53% of property owners and have not received any since. While the 53% approval falls short of the 66% normally required, we believe the renaming is necessary and .should occur with the zip code change. Several property owners have called in the last several months to see when the change would take place. Since the USPS has redrawn zip code boundaries, we've received more calls with concerns about changing the name soon enough to limit the negative impact on the affected businesses and property owners.
