R-07-06-28-11E1 WHEREAS, on February 8, 2007, the City of Round Rock entered into an Interlocal Agreement Regarding Ancillary Consulting Services for Regional Water System ("Agreement") with the City of Cedar Park and the City of Leander ("Parties") , and WHEREAS, pursuant to the Agreement, the City and Parties wish to enter into a Memorandum of Agreement to approve the Client Additional Services Authorization, dated June 15, 2007, between the Project Consultant and the City of Cedar Park, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City a Memorandum of Agreement with the City of Cedar Park and the City of Leander, a copy of same being attached hereto as Exhibit "A" and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider a resolution authorizing the Mayor to execute a Memorandum of Agreement with the City of Cedar Park and the City of Leander pursuant to the Interlocal Agreement Regarding Ancillary Consulting Services for Regional Water System for right-of-way acquisition services. Thane, Utility Director ,justification: These additional services are for Land Acquisition Services for permanent and temporary construction easements for the Trails End raw water pipeline route to deliver Lake Travis Water to the Regional Water Treatment Plant. The Parties according to their ultimate capacity allocation percentage in the Regional Water System shall share all costs. These percentages are as follows: Round Rock, 38.56%; Cedar Park, 14.18%; and Leander, 47.26%. To provide Land Acquisition Services, the following must be acquired and prepared: 45 temporary construction easements, which are required to construct the subject project, and 9 permanent easements; appraisal reports on 9 permanent easements and value findings for the temporary construction easements (2 for residential properties, 1 for commercial properties, and 1 for vacant land properties). Fundina: Cost: $66,893.89 Source of funds: Capital Project Funds (Self-Financed Utility) Outside Resources: Lockwood, Andrews, & Newnam, Inc., City of Cedar Park, City of Leander Backaround Information: On February 8, 2007, the City entered into an Interlocal Agreement Regarding Ancillary Consulting Services for Regional Water System with the City of Cedar Park and the City of Leander. The original Land Acquisition Services contract was approved on March 21, 2007 by all three cities. Additional temporary and permanent easements are required because of a change in the .proposed raw water line route. The total cost of the original contract was for $58,500 with the City of Round Rock's percentage being 38.56%, based on an ultimate capacity in the system of 40.8 mgd. Pursuant to the agreement, the Cities of Round Rock, Cedar Park and Leander wish to enter into a Memorandum of Agreement to approve the Client Additional Services Authorization, dated June 15, 2007, between the Project Consultant and the City of Cedar Park.
