WHEREAS, the City of Round Rock has adopted a Hotel Occupancy
Tax in accordance with V.T.C.A. , Tax Code §351. 002, and
WHEREAS, the City evaluates funding requests from local agencies
to help fund community events and institutions which will directly
enhance and promote tourism and the convention and local hotel
industry, and
WHEREAS, the City has previously entered into a Funding Agreement
with Palm House Museum Association dated December 21, 2006 under
Resolution No. R-06-12-21-9A3, and such Funding Agreement is still in
force and effect according to its term, and
WHEREAS, in accordance with V.T.C.A. , Tax Code §351.101, the City
has received a request for additional funding from the Palm House
Museum Association, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City Supplemental Agreement No. 1 to the "City of Round
Rock Convention and Visitors Bureau Funding Agreement with Palm House
Museum Association" , a copy of same being attached hereto as Exhibit
"A" and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted

TO"CITY OF ROUND ROCK CONVENTION AND VISITORS BUREAU
FUNDING AGREEMENT WITH PALM HOUSE MUSEUM ASSOCIATION"
This Supplemental Agreement No. 1 to "City of Round Rock Convention and Visitors
Bureau Funding Agreement with Palm House Museum Association"is made by and between the
City of Round Rock, Texas,hereinafter called the"City,"and Palm House Museum Association,
hereinafter called the"Applicant."
WHEREAS, City and Applicant executed the referenced "City of Round Rock
Convention and Visitors Bureau Funding Agreement with Palm House Museum Association,"
hereinafter called the"Agreement,"on the 21 st day of December,2006; and
WHEREAS, it has become necessary to amend the Agreement to provide for additional
funding;
NOW THEREFORE, premises considered, City and Applicant agree that said
Agreement is amended as follows:
Page 1.First Paragraph shall be amended as follows:
This City of Round Rock Convention and Visitors Bureau Funding Agreement (herein
referred to as the"Agreement")is by and between the City of Round Rock(herein referred to as
the "City") and the Palm House Museum Association (herein referred to as the "Applicant").
Pursuant to the terms of this Agreement, and responsive to the Applicant's 2006-2007
Application/Request for Funding, the City hereby agrees to allocate the total not-to-exceed sum
of Fifteen Thousand Five Hundred Sig and No/100 Dollars ($15,506.00) to the Applicant to
fulfill the statutorily-allowable purposes outlined by the City and by the Applicant herein. The
Applicant expressly acknowledges that the City has previously disbursed a partial payment of
Eight Thousand and No/100 Dollars ($8,000.00) from said not-to-exceed amount, leaving a
balance due for disbursement of Seven Thousand Five Hundred Six and No/100 Dollars
($7,506.00).
Subsection 1.2 shall be amended as follows:
1.2 Distribution of Funds. The City will pay the balance due for disbursement of
Seven Thousand Five Hundred Six and No/100 Dollars ($7,506.00) to the Applicant on or
after the date that the City is in receipt of all necessary documentation, and the funds have been
approved by the City for disbursement.

Subsection L. a}shall be amended as follows:
a. The Applicant shall ensure that any contributed funds are spent to directly
enhance and promote tourism and the convention and hotel industry in this area, and shall ensure
that any contributed funds are spent in compliance with guidelines and/or restrictions placed
either upon the funds or upon reporting of the funds by the City or the Round Rock Convention
and Visitors Bureau. The following restrictions are hereby placed upon the funds:
(1) $ 1,500.00 is the maximum amount that may be spent on brochures
(2) $ 400.00 is the maximum amount that may be spent on insurance
(3) $13,606.00 is the maximum amount that may be spent on repairs and
building improvements only as delineated on Exhibit"A" attached hereto
and incorporated herein for all purposes.
Subsection 1.7 shall be re-numbered as Subsection 1.6.
Subsection 1.8 shall be re-numbered as Subsection 1.7.
Subsection 1.9 shall be re-numbered as Subsection 1.8.
There shall be no other changes in terms or conditions of the original Agreement.
IN WITNESS WHEREOF, the City and Applicant have executed this Supplemental
Agreement No. 1 in duplicate originals.
