R-01-01-25-10B1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROUND ROCK, HEREINAFTER REFERRED TO AS "APPLICANT", DESIGNATING CERTAIN OFFICIALS AS BEING RESPONSIBLE FOR, ACTING FOR AND ON BEHALF OF THE APPLICANT IN DEALING WITH THE TEXAS PARKS AND WILDLIFE DEPARTMENT, HEREINAFTER REFERRED TO AS "DEPARTMENT", FOR THE PURPOSE OF PARTICIPATING IN THE TEXAS RECREATION AND PARKS ACCOUNT GRANT PROGRAM, HEREINAFTER REFERRED TO AS THE "PROGRAM"; CERTIFYING THAT THE APPLICANT IS ELIGIBLE TO RECEIVE PROGRAM ASSISTANCE; CERTIFYING THAT THE APPLICANT MATCHING SHARE IS READILY AVAILABLE; DEDICATING THE PROPOSED SITE FOR PERMANENT PUBLIC PARK AND RECREATIONAL USES; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Texas Legislature has approved the Program (Section 24 of the Parks & Wildlife Code) for the purpose of allowing the political subdivision of the State of Texas to participate in the Program, and WHEREAS, the Applicant is fully eligible to receive assistance under the Program, and WHEREAS, the Applicant is desirous of authorizing Sharon Prete, Parks and Recreation Director, to represent and act for the Applicant in dealing with the Department concerning the Program, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS THAT, Section l : The Applicant hereby certifies that they are eligible to receive assistance under the Program. K:\WPDOCS\RESOLUTI\R10125B1.WPD/sc Section 2 : The Applicant hereby certifies that, subject to the approval of the Williamson County Commissioner' s Court' s contribution to the trail project, the matching share for this application is readily available . Section 3 : The Applicant hereby officially designates Sharon Prete, Parks and Recreation Director, as its representative in dealing with the Department for the purpose of the Program. Section 4 : The Applicant hereby specifically authorizes Sharon Prete, Parks and Recreation Director, to make application to the Department concerning several park sites which will be used for the Brushy Creek Trail in the City of Round Rock, and that the said sites have been dedicated for public park and recreation purposes . The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended, and the Act . Consider a resolution authorizing the Parks and Recreation Department Director to act as the City of Round Rock's agent in all matters concerning the Brushy Creek Trail grant application of the Texas Parks and Wildlife Department. Resource: Sharon Prete, Parks and Recreation Director History: The Parks, Recreation and Open Space Master Plan has called for the acquisition of creek properties for the development of trails since the plan was originally adopted in 1982. Through developer contributions and the donation by Mrs. Freeman, the City has amassed approximately 65 linear acres along the south side of Brushy Creek(see attachment) for the purpose of developing a trail and providing passive recreation opportunities. Precinct 4 Williamson county Commissioner, Frankie Limmer, wishes to participate in this project by contributing $1 million for the development of the trail system and other amenities. Funding: Cost: $1.5 million Source of funds: $1 million is being contributed by Williamson County and $500,000 would come from the Texas Parks and Wildlife Department Parks and Recreation account. Note: No funding is required of the City for this phase of the project. Outside Resources: N/A Impact: This joint venture places development cost on the County and State and only O&M responsibility on the City. Benefit: The citizens will benefit greatly from the development of approximately 2.5 miles of trail. Public Comment: Public Hearing to be held January 25, 2001 Sponsor: City and Williamson County.
