WHEREAS, the City of Round Rock has previously entered into a
contract ("Contract" ) with Payton Construction, Inc. for the Raw Water
Pump Station Expansion Project, and
WHEREAS, the Council has determined that it is necessary to make
changes to the plans or specifications of the Contract due to
unforeseen circumstances, and
WHEREAS, it has been determined that it is necessary to change
said Contract in accordance with the attached Contract Change Order No.
2 , and
WHEREAS, the Council has determined that this Change Order No. 2
will not result in an increase of the original contract price by more
than 25 percent, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City Contract Change Order No. 2 to the Contract with
Payton Construction, Inc . for the Raw Water Pump Station Expansion
Project .
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted

upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended, and the Act .

Dear Mr.Stephens:
This letter transmits three copies of Change Order No. 2 for the Raw Water Pump Station
Expansion Project. The HVAC relocation cost shall include at a minimum the HVAC unit
relocation,concrete pad,grading work and reworking the ductwork including
weatherproofing and duct supports. The buried armored cable cost shall include at a
mir- mum the moving of the armored cable to the City cut ditch,placing the armored cable
in the ditch,covering the armored cable in the ditch,provide moisture proof caps for the
ends of the armored cable and support the ends of the armored cable off of the ground in a
terminal box. Please review,sign and return the three-signed copies of Change Order No.
2 to Mr.Don Rundell at the City by Monday,January 8,2001.
In addition,as indicated in the letter from me to you dated October 6,2000,a credit is due
to the Owner for allowing the deposition of spoils. If you have any questions or
comments,please let me know.

SUBJECT: City Council Meeting—January 25, 2001
ITEM: 10.C.4. Consider a resolution authorizing the Mayor to execute Change
Order No. 2 to the contract for the Raw Water Pump Station
Expansion Project with Payton Construction, Inc.for changes to
the plans or specifications of the Contract due to unforeseen
circumstances. This will require and additional cost of$26,877.00
bringing the contract total to $2,500,737.00 for a total increase to
the original contract amount of 6.14%. This project to upgrade the
Raw Water Pump Station was necessary to deliver raw water to the
Water Treatment Plant in an amount equal to the new plant capacity
created with the Phase IV Water Treatment Plant expansion. In
addition to adding the three 6-mgd pumps with controls and
equipment building this project added a generator and other
appurtenances to ensure the reliable delivery of potable water to the
citizens of Round Rock.

shortages to our customers.
