RESOLUTION NO. R-01-06-28-12C2 WHEREAS, the City of Round Rock has previously entered into a contract for engineering services ("Contract" ) with Carter & Burgess, Inc . for the preparation of plans, specifications, and estimates for 1 . 5 miles of US 79 from CR 195 to FM 1460, and WHEREAS, Carter & Burgess, Inc . has submitted Supplemental Agreement No. 1 to the Contract for a change in the scope of services and to extend the contract date, and WHEREAS, the City Council desires to enter into said Supplemental Agreement No. 1 to the Contract with Carter & Burgess, Inc . , Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental Agreement No. 1 to the Contract with Carter & Burgess, Inc . for a change in the scope of services and to extend the contract date, a copy of said supplemental agreement being attached hereto and incorporated herein for all purposes . The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas 0:\WPDOCS\RESOLUTI\R10628C2.WPD/SC Government Code, as amended, and the Act . STLUKA, JR. , ayor City of Round Rock, Texas ATTEST: A A A4,djZA4tz& J E LAND, City Secretary 2 STATE OF TEXAS § Contract No. COUNTY OF WILLIAMSON § SUPPLEMENTAL AGREEMENT NO. 1 CONTRACT FOR ENGINEERING SERVICES THIS SUPPLEMENTAL AGREEMENT to contract for engineering services is made by and between the City of Round Rock, hereinafter called the "City", and Carter-Burgess, Inc., hereinafter called the "Engineer", and becomes effective when fully executed by both parties. WITNESSETH WHEREAS, the City and the Engineer executed a contract on the 23`d day of March 2000 concerning the design of a four-lane divided section on US 79 from FM 1460 to CR 195 to include bridge design at Arterial A; and, WHEREAS, Article 3, Contract Period, requires work to be completed on or before close of business on August 31, 2001; and, WHEREAS, Article 4. Compensation, limits the maximum amount payable for the contract to $398,182; and, WHEREAS,it has become necessary to amend the contract; AGREEMENT NOW THEREFORE, premises considered, the City and the Engineer agree that said contract is amended as follows: I. The Engineer will be performing additional work concerning the extension of project limits 1400 feet west of FM1460, as shown in Exhibit B. II. The Contract termination date is extended to December 31, 2002. III. The maximum amount payable of the contract is increased by$158,118.00, as shown in Exhibit D, to $556,300.00. 1 of 2 ALL OTHER PROVISIONS ARE UNCHANGED AND REMAIN IN FULL FORCE AND EFFECT. EXHIBIT "B" ADDITIONAL SERVICES TO BE PROVIDED BY THE ENGINEER PROJECT: US 791H 35 LIMITS: From West of FM 1460 to CR 195 LENGTH: 1.77 Miles CONTROL: 0204-01-OXX COUNTY: Williamson Project limits were extended to 1400 feet west of FM 1460. As a result, Carter & Burgess, Inc., herein after called the ENGINEER, shall provide the following additional services: The extension required establishment of horizontal control and the addition of a benchmark for the new section. Additional Right-of Way will be surveyed and staked and adjacent parcels will have to be researched. Utility location in the new section will be determined. Additional Right-of-Way sheets will be prepared. Horizontal and vertical alignments through the intersection will be designed with the typical section changed to a curb and gutter section. Drainage design through the area will also change to a curb and gutter section. Additional bore holes will be required. Signing and striping and traffic control plans will be determined. An intersection traffic signal system will be designed. A tie-in to the future extension of Double Creek will be added. Additional pull boxes and conduit are necessary for the openings at the Double Creek and Arterial A connections. An additional bridge will be designed and quantified at Arterial B. Additional bore holes will be required. A detailed drainage study is required. The existing 3-6'x6' culvert was added as well as 2- 6'x6' boxes. The downstream channel will be analyzed to determine if it can convey the additional flow. The downstream channel will be surveyed to provide required information for analysis. The design of a culvert for the offsite area east of FM 1460 and north of US 79 is necessary. Coordination with adjacent landowners will increase, including provision of plots and other requested information. Consider a resolution authorizing the Mayor to execute Supplemental Agreement No. Ito the Contract for Engineering Services with Carter& Burgess, Inc.for the preparation of plans, specifications, and estimates for 1.5 miles of US 79 from CR 195 to FM 1460. The original contract was approved on March 23, 2000, for the preparation of plans, specifications, and estimates for 1.5 miles of US 79 from County Road 195 to FM 1460. This Supplemental Agreement No. 1 will extend the contract to December 31, 2002 and modify the Scope of Work to extend the project limits to 1,400 feet west of FM 1460. At a cost of $158,118 which will bring the total cost of the contract to $556,300.
