WHEREAS, the City of Round Rock has previously entered into a
contract for engineering services ( "Contract" ) with HDR Engineering,
Inc . for the design and permitting of railroad crossings for Arterial
A, and
WHEREAS, HDR Engineering, Inc . has submitted Supplemental
Agreement No. 1 to the Contract for a change in the scope of services
and to extend the contract date, and
WHEREAS, the City Council desires to enter into said Supplemental
Agreement No. 1 to the Contract with HDR Engineering, Inc . , Now
Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City Supplemental Agreement No. 1 to the Contract with
HDR Engineering, Inc . for a change in the scope of services, and to
extend the contract date, a copy of said supplemental agreement being
attached hereto as Exhibit "A" and incorporated herein for all
purposes .
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted

SUPPLEMENTAL AGREEMENT NO. 1
TO CONTRACT FOR ENGINEERING SERVICES
This Amendment to the Contract for Engineering Services is made by and between the City of
Round Rock, Texas, hereinafter called the "City" and HDR Engineering, Inc., hereinafter called
the "Engineer".
WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter
called the "Contract," on the 24`h day of February, 2000 concerning Arterial A UPRR Underpass.
WHEREAS, ARTICLE 2, SCOPE OF SERVICES TO BE PROVIDED BY ENGINEER,
describes those engineering services to be provided by the Engineer as a part of the Contract, and
WHEREAS, ARTICLE 3, CONTRACT PERIOD, requires termination of the Contract on July
01, 2001 unless the Contract is extended, and
WHEREAS, ARTICLE 4, COMPENSATION, establishes the maximum lump sum payable
under this contract at $258,530.00 and the maximum the subconsultant hourly services fee
payable under this contract at $28,550.00 without modification of the contract, and
WHEREAS, it has become necessary to amend the contract to provide for a change in the scope
of services to include preliminary schematic design, preliminary storm water recommendations
and topographic roadway and utility survey services, and
WHEREAS, it is in the City's best interest to extend the term of the Contract until April 30,
2003, and
WHEREAS, the Engineer has agreed to perform the additional work for $92,285.00 which
includes $ 52,885.00 lump sum and $39,400.00 for subconsultant hourly services increasing the
lump sum fee for the contract to $311,415.00 and increasing the subconsultant hourly services
fee for the contract to $67,950.00.
NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract
is amended as follows:
ARTICLE 3, CONTRACT PERIOD, shall be extended until April 30, 2003.
ARTICLE 4, COMPENSATION shall be amended by changing the lump sum amount payable
under this contract to $311,415.00 and by changing the subconsultant hourly services fee amount
payable under this contract to $67,950.00.

Additional Services to be provided by HDR
The work to be performed under this supplemental agreement shall consist of providing the
following items/information:
Preliminary Schematic —HDR Engineering, Inc.
1. Provide additional project management and sub-consultant management.
2. Identify affected utility companies.
3. Provide a Microstation format on compatible archive media containing all graphics files used
in developing the schematic and all Geopak (Gpk) alignment files.
4. Collect, review, and evaluate available existing data pertaining to project.
5. The Schematic shall be prepared for and submitted to the City of Round Rock for approval
and will include the following:
• Prepare preliminary design;
• Develop design criteria for the roadway;
• Determine limits of construction.
Prior to preparing detailed schematic plans for Arterial A, the Engineer will prepare one
preliminary schematic layout (horizontal alignment) that indicates the geometric features and
location requirements particular to Arterial A. Schematics are to be drawn in Microstation,
(dgn format). Alignment to be calculated in Geopak application. The Engineer will prepare a
calculated geometric layout on a continuous roll in plan and profile to a scale of 1" = 100'
horizontal and 1" = 10' vertical. The layout will show the location and description of typical
sections to describe the geometric design of the facility. The Engineer will establish and
verify right-of-way requirements for the facility. All geometric design for a 45-mph design
speed will conform to the ITE Urban Street standards. The Engineer will provide one
preliminary and one ultimate schematic design that will be comprised of the following
elements:
• Horizontal alignment;
• Vertical alignment;
• Typical Sections will include main lanes; and
• Typical Sections are to be developed for proposed conditions.
• Typical section width as provided by the City shall be used. The City shall provide the
width which considers future light rail expansion.
• The schematic near the intersection of Arterial A and Chandler Creek and pass under US
79 and UPRR until it terminates at existing grade north of Brushy Creek and South of the
US 79 and UPRR. The vertical alignment for this segment of Arterial A will meet the
above mentioned design speed and does not include considerations for the vertical or
Horizontal alignment requirements for light rail. Any alignment and survey requirements
for light rail facilities other than the typical section will need to be part of a subsequent
supplemental agreement.
The Plan View should show the location of Arterial A and cross roads, edge of pavement,
shoulder, curbs, bridges, retaining walls, concrete barriers, turn lanes, direction of traffic flow

on all roadways, existing property lines, directions of turning movements, number of lanes,
preliminary pavement markings to include gore areas, turn lanes, etc. No control of access
issues will be identified or shown. For the Schematic, the alignment should be investigated to
the extent to ensure the following:
• Existing hydrologic features are understood and accommodated within policy and
regulation.
• Adequate gutter slope and ditch grades are developed.
• Obtain the FEMA Flood Insurance Study for Brushy Creek and Chandler Branch.
• Perform and document hydraulic computations for the preliminary sizing of storm sewers
and inlets and attempt to place without undue expense or special design.
Survey— SAM, Inc.
1. Place the location of existing utilities on the survey schematic. Provide a list of utility
owners.
2. Locate existing underground utilities horizontally within the limits of the survey. Vertically
locate, coordinate and have exposed by the appropriate utility company the identified'
underground utilities within the survey area defined.
3. Provide X, Y, and Z coordinates of above ground utility lines, power poles, manholes, and
storm sewer lines and inlets, etc.
4. Obtain right of entry to properties.
5. All coordinate geometry will be based on and tied into the State's, USGS, and FEMA
coordinate system.
6. Field surveys shall be required for the establishment of a horizontal base line and benchmark
circuit for the project, horizontal and vertical ties of critical existing facilities and features,
including all features influencing existing streets and driveways, and of the existing right-of-
way lines. The Surveyor will stake in the field P.I.'s, P.O.T.'s, P.C.'s and P.T.'s for the
approved centerline alignment.
7. Establish benchmarks in locations that will not be disturbed by construction and tie
benchmark elevation to known USGS and FEMA reference mark.
8. Provide location of permanent project benchmarks and traverse points (description,
coordinates and elevations). Topographic mapping and profile the entire survey area.
Provide topographic map plot at a scale of 1"=100', depicting all surface features, legible text
(leadered in if necessary) and 1-foot contour lines indexed at even 5-foot intervals. Show
existing Right-Of-Way on US 79, CR 195, intersecting side streets identified above, and
UPRR. Forward hard copy plots and digital files (digital files shall be in MicroStation SE —
3D format on CD-ROM or DOS 1.44 MB, 3.5-inch diskettes). Provide a separate
MicroStation SE file that contains 3D breaklines, existing ground triangulation network and
contours with elevations. Provide digital ASCII file (on CD-ROM or DOS 1.44 MB, 3.5-inch
diskettes) and hard paper copy of all survey points in (point number, Northern, Eastern,
elevation, description) format. Provide detailed field book sketches, legibly indicating
dimensions and survey shot numbers.
9. Cross-section 400' wide strip within defined survey limits. Cross-section US 79 roadway to
ensure development of a detailed DTM to determine actual field conditions.
10. Profile existing drainage facilities. Profile both Brushy Creek and Chandler Branch for 1000'
to the east of the proposed intersection with Arterial A.
11. Ties to existing bridges or culverts that may conflict with new construction.

12. Obtain stationing on all side road and/or driveway pipes and offset distances from centerline
of highway. Also, the type of surface, width of roadway or driveway, and skew to centerline
shall be noted. Measure size, length and type of pipe. Obtain flowline elevations of existing
culverts and ditches and center of driveway or roadway elevations.
13. Locate all mailboxes (single, double ,etc.), signs including size, types, location and verbiage.
Measure all guardrail and permanent erosion control measures. Collect the required
miscellaneous information including; measurements of riprap, retaining walls, drainage
culverts and structures and note types, sizes, and shapes, measure pier size and skew angle.
14. No Aerial Services are included under this scope of services.

Dear George,
Subsequent to our recent telephone conversations regarding the above
referenced project we have been in contact with the UPRR to discuss obtaining right-of-
entry (ROE) to thier right-of-way (ROW ) with a truck mounted drill rig. The costs and
effort of obtaining a ROE for such equipment is significant and potentially time
consuming. Borings can be drilled on the TxDot ROW but borings to the south would
require either access onto the UPRR ROW or on the private property (farmland) to the
south of the UPRR.
We understand it may be possible to obtain ROE from the private landowner,
which would simplify the process. However, if denied by the landowner, then ROE from
the UPRR would be necessary. Based on the above, it is suggested the Geotechnical
budget be increased by $4000.00 over the amount of our proposal dated February 9,
2000 to be used only if necessary to gain access onto the UPRR. Obviously, if not
required to obtain ROE, the additional funding would not be used.

RE: Arterial "A"—Railroad Cost Estimate
Dear Mr. Tillett,
Our estimate for the railroad fees associated with this project did not include the use of a UPRR
flag person or the requirement of railroad liability insurance. We contacted Mr. Kristian Ehrhorn of
UPRR (402-997-3567) and explained what we will be doing and for what length of time. He
informed us that both of the above items are a requirement since we will be within 25 feet of the
tracks. The insurance requirement was implemented by UPRR this year. We asked Mr. Ehrhorn
to provide us with a letter that shows the related fees and he refused. He stated that when our
application has been approved and the written contract has been drafted it will contain the cost
breakdown.
We have obtained information from Mr. Ehrhorn and Mr. Gene Suing (402-280-6235) the UPRR
representatives and their web site to compile an estimated total pass through cost for the railroad
fees of$9,450.00. (See attached) Our original proposal only contained $4,050.00 for railroad
fees. Thus we will need to amend our fee based on this additional pass through cost.

an initial review. Incomplete applications will halt processing.
8. The normal turn-around time for processing applications is now
running between 30-45 days. Please allow sufficient time for the
handling of your request. Please do not call within the initial 30
days of receipt of your request for the status of your application.
Time in answering your phone calls only delays the processing of

10. Before you enter the railroad company's right-of-way, the
following must be completed:
o All agreements must be executed by the applicant and
the railroad company. A copy of the executed agreement
must be within the applicant's possession before entering
the railroad company's right-of-way.
c Verbal Authorizations will not be permitted or granted.
Generally, a minimum of 48 hours' advance notice after
execution of an agreement will be required prior to entry.
o License fees and insurance certificates, if required, must
be submitted at the time you execute and return the
agreement.
o Clearance and approval from the railroad company's Fiber
Optic Cable Hotline (800) 336-9193.
O Arrangements must have been made with the railroad
company's local manager of track maintenance, as listed
in the agreement, for flagging protection (if required).
a If your project requires work within 25 feet of the track or
could be considered hazardous, you may be required to
obtain Railroad Protective Liability Insurance. This may be
purchased from an insurance agent of your choice, or you
may be eligible for inclusion in UPRR's Railr_.oad.._Protective
Liability_Insurance program.
11. The terms of the railroad company's standard agreements are
non-negotiable. Please do not attempt to make any changes to

History: On February 24, 2000 the Council approved Resolution No. 00-02-24-11F8 which
allowed HDR Engineering, Inc., to provide coordination with the Union Pacific
Railroad for approval of the Arterial "A"Underpass. HDR is developing complete
plans for the proposed bridge and shoo-fly of the Union Pacific Railroad Underpass
at Arterial "A"under this resolution. This additional agreement will cover the
development of the proposed survey, schematic and associated storm water design
which are needed prior to beginning design services for Arterial A under the railroad
structures. This additional work will be provided in the amount of$92,285 which
includes a $39,400 sub-consultant fee for surveying and $52,885 lump sum for
preliminary schematic preparation and preliminary storm water hydraulics bringing
the total cost of the project to $311,415. Staff recommends approval.

SUPPLEMENTAL AGREEMENT NO. 1
TO CONTRACT FOR ENGINEERING SERVICES
This Amendment to the Contract for Engineering Services is made by and between the City of
Round Rock, Texas, hereinafter called the "City" and HDR Engineering, Inc., hereinafter called
the "Engineer".
WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter
called the "Contract," on the 24th day of February, 2000 concerning Arterial A UPRR Underpass.
WHEREAS, ARTICLE 2, SCOPE OF SERVICES TO BE PROVIDED BY ENGINEER,
describes those engineering services to be provided by the Engineer as a part of the Contract, and
WHEREAS, ARTICLE 3, CONTRACT PERIOD, requires termination of the Contract on July
01, 2001 unless the Contract is extended, and
WHEREAS, ARTICLE 4, COMPENSATION, establishes the maximum lump sum payable
under this contract at $258,530.00 and the maximum the subconsultant hourly services fee
payable under this contract at $28,550.00 without modification of the contract, and
WHEREAS, it has become necessary to amend the contract to provide for a change in the scope
of services to include preliminary schematic design, preliminary storm water recommendations
and topographic roadway and utility survey services, and
WHEREAS, it is in the City's best interest to extend the term of the Contract until April 30,
2003, and
WHEREAS, the Engineer has agreed to perform the additional work for $92,285.00 which
includes $ 52,885.00 lump sum and $39,400.00 for subconsultant hourly services increasing the
lump sum fee for the contract to $311,415.00 and increasing the subconsultant hourly services
fee for the contract to $67,950.00.
NOW THEREFORE,premises considered, the City and the Engineer agree that said Contract
is amended as follows:
ARTICLE 3, CONTRACT PERIOD, shall be extended until April 30, 2003.
ARTICLE 4, COMPENSATION shall be amended by changing the lump sum amount payable
under this contract to $311,415.00 and by changing the subconsultant hourly services fee amount
payable under this contract to $67,950.00.
ATTACHMENT "B", Services to be Provided by the Engineer shall be amended as set forth in
the attached ADDENDUM NO. 1 to ATTACHMENT B.

Additional Services to be provided by HDR
The work to be performed under this supplemental agreement shall consist of providing the
following items/information:
Preliminary Schematic—HDR Engineering, Inc
1. Provide additional project management and sub-consultant management.
2. Identify affected utility companies.
3. Provide a Microstation format on compatible archive media containing all graphics files used
in developing the schematic and all Geopak (Gpk) alignment files.
4. Collect, review, and evaluate available existing data pertaining to project.
5. The Schematic shall be prepared for and submitted to the City of Round Rock for approval
and will include the following:
• Prepare preliminary design;
• Develop design criteria for the roadway;
• Determine limits of construction.
Prior to preparing detailed schematic plans for Arterial A, the Engineer will prepare one
preliminary schematic layout (horizontal alignment) that indicates the geometric features and
location requirements particular to Arterial A. Schematics are to be drawn in Microstation,
(dgn format). Alignment to be calculated in Geopak application. The Engineer will prepare a
calculated geometric layout on a continuous roll in plan and profile to a scale of V = 100'
horizontal and 1" = 10' vertical. The layout will show the location and description of typical
sections to describe the geometric design of the facility. The Engineer will establish and
verify right-of-way requirements for the facility. All geometric design for a 45-mph design
speed will conform to the ITE Urban Street standards. The Engineer will provide one
preliminary and one ultimate schematic design that will be comprised of the following
elements:
• Horizontal alignment;
• Vertical alignment;
• Typical Sections will include main lanes; and
• Typical Sections are to be developed for proposed conditions.
• Typical section width as provided by the City shall be used. The City shall provide the
width which considers future light rail expansion.
• The schematic near the intersection of Arterial A and Chandler Creek and pass under US
79 and UPRR until it terminates at existing grade north of Brushy Creek and South of the
US 79 and UPRR. The vertical alignment for this segment of Arterial A will meet the
above mentioned design speed and does not include considerations for the vertical or
Horizontal alignment requirements for light rail. Any alignment and survey requirements
for light rail facilities other than the typical section will need to be part of a subsequent
supplemental agreement.
The Plan View should show the location of Arterial A and cross roads, edge of pavement,
shoulder, curbs, bridges, retaining walls, concrete barriers, turn lanes, direction of traffic flow

on all roadways, existing property lines, directions of turning movements, number of lanes,
preliminary pavement markings to include gore areas, turn lanes, etc. No control of access
issues will be identified or shown. For the Schematic, the alignment should be investigated to
the extent to ensure the following:
• Existing hydrologic features are understood and accommodated within policy and
regulation.
• Adequate gutter slope and ditch grades are developed.
• Obtain the FEMA Flood Insurance Study for Brushy Creek and Chandler Branch.
• Perform and document hydraulic computations for the preliminary sizing of storm sewers
and inlets and attempt to place without undue expense or special design.
Survey— SAM, Inc.
1. Place the location of existing utilities on the survey schematic. Provide a list of utility
owners.
2. Locate existing underground utilities horizontally within the limits of the survey. Vertically
locate, coordinate and have exposed by the appropriate utility company the identified
underground utilities within the survey area defined.
3. Provide X, Y, and Z coordinates of above ground utility lines, power poles, manholes, and
storm sewer lines and inlets, etc.
4. Obtain right of entry to properties.
5. All coordinate geometry will be based on and tied into the State's, USGS, and FEMA
coordinate system.
6. Field surveys shall be required for the establishment of a horizontal base line and benchmark
circuit for the project, horizontal and vertical ties of critical existing facilities and features,
including all features influencing existing streets and driveways, and of the existing right-of-
way lines. The Surveyor will stake in the field P.I.'s, P.O.T.'s, P.C.'s and P.T.'s for the
approved centerline alignment.
7. Establish benchmarks in locations that will not be disturbed by construction and tie
benchmark elevation to known USGS and FEMA reference mark.
8. Provide location of permanent project benchmarks and traverse points (description,
coordinates and elevations). Topographic mapping and profile the entire survey area.
Provide topographic map plot at a scale of F'= depicting all surface features, legible text
(leadered in if necessary) and 1-foot contour lines indexed at even 5-foot intervals. Show
existing Right-Of-Way on US 79, CR 195, intersecting side streets identified above, and
UPRR. Forward hard copy plots and digital files (digital files shall be in MicroStation SE —
3D format on CD-ROM or DOS 1.44 MB, 3.5-inch diskettes). Provide a separate
MicroStation SE file that contains 3D breaklines, existing ground triangulation network and
contours with elevations. Provide digital ASCII file (on CD-ROM or DOS 1.44 MB, 3.5-inch
diskettes) and hard paper copy of all survey points in (point number, Northern, Eastern,
elevation, description) format. Provide detailed field book sketches, legibly indicating
dimensions and survey shot numbers.
9. Cross-section 400' wide strip within defined survey limits. Cross-section US 79 roadway to
ensure development of a detailed DTM to determine actual field conditions.
10. Profile existing drainage facilities. Profile both Brushy Creek and Chandler Branch for 1000'
to the east of the proposed intersection with Arterial A.
11. Ties to existing bridges or culverts that may conflict with new construction.

12. Obtain stationing on all side road and/or driveway pipes and offset distances from centerline
of highway. Also, the type of surface, width of roadway or driveway, and skew to centerline
shall be noted. Measure size, length and type of pipe. Obtain flowline elevations of existing
culverts and ditches and center of driveway or roadway elevations.
13. Locate all mailboxes (single, double ,etc.), signs including size, types, location and verbiage.
Measure all guardrail and permanent erosion control measures. Collect the required
miscellaneous information including; measurements of riprap, retaining walls, drainage
culverts and structures and note types, sizes, and shapes, measure pier size and skew angle.
14. No Aerial Services are included under this scope of services.

Dear George,
Subsequent to our recent telephone conversations regarding the above
referenced project we have been in contact with the UPRR to discuss obtaining right-of-
entry (ROE) to thier right-of-way (ROW) with a truck mounted drill rig. The costs and
effort of obtaining a ROE for such equipment is significant and potentially time
consuming. Borings can be drilled on the TxDot ROW but borings to the south would
require either access onto the UPRR ROW or on the private property (farmland) to the
south of the UPRR.
We understand it may be possible to obtain ROE from the private landowner,

RE: Arterial "A"— Railroad Cost Estimate
Dear Mr. Tillett,
Our estimate for the railroad fees associated with this project did not include the use of a UPRR
flag person or the requirement of railroad liability insurance. We contacted Mr. Kristian Ehrhorn of
UPRR (402-997-3567) and explained what we will be doing and for what length of time. He
informed us that both of the above items are a requirement since we will be within 25 feet of the
tracks. The insurance requirement was implemented by UPRR this year. We asked Mr. Ehrhorn
to provide us with a letter that shows the related fees and he refused. He stated that when our
application has been approved and the written contract has been drafted it will contain the cost
breakdown.
We have obtained information from Mr. Ehrhorn and Mr. Gene Suing (402-280-6235) the UPRR
representatives and their web site to compile an estimated total pass through cost for the railroad
fees of$9,450.00. (See attached) Our original proposal only contained $4,050.00 for railroad
fees. Thus we will need to amend our fee based on this additional pass through cost.

o All agreements must be executed by the applicant and
the railroad company. A copy of the executed agreement
must be within the applicant's possession before entering
the railroad company's right-of-way.

Generally, a minimum of 48 hours' advance notice after
execution of an agreement will be required prior to entry.
o License fees and insurance certificates, if required, must
be submitted at the time you execute and return the
agreement.

Dear George,
- Subsequent to our recent telephone conversations regarding the above
referenced project we have been in contact with the UPRR to discuss obtaining right-of-
entry (ROE) to thier right-of-way (ROW) with a truck mounted drill rig. The costs and
effort of obtaining a ROE for such equipment is significant and potentially time
consuming, Borings can be drilled on the TxDot ROW but borings to the south would
require either access onto the UPRR ROW or on the private property (farmland) to the
south of the UPRR.
We understand it may be possible to obtain ROE .from the private landowner,
which would simplify the process. However, if denied by the landowner, then ROE from
the UPRR would be necessary. Based on the above, it is suggested the Geotechnical
budget be increased by $4000.00 over the amount of our proposal dated February 9,
2000 to be used only if necessary to gain access onto the UPRR. Obviously, if not
required to obtain ROE, the additional funding would not be used.
