WHEREAS, the City of Round Rock has previously entered into a
contract for engineering services ("Contract") with Carter & Burgess,
Inc . for the preparation of plans, specifications, and estimates for
1 . 5 miles of US 79 from FM 1460 to CR 195, and
WHEREAS, Carter & Burgess, Inc . has submitted Supplemental
Agreement No . 2 to the Contract for a change in the scope of services,
to develop plans and specifications for additional illumination of US
79 and
WHEREAS, the City Council desires to enter into said Supplemental
Agreement No. 2 to the Contract with Carter & Burgess, Inc . , Now
Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City Supplemental Agreement No. 2 to the Contract with
Carter & Burgess, Inc . for a change in the scope of services, a copy of
said supplemental agreement being attached hereto as Exhibit "A" and
incorporated herein for all purposes .
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the

public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas

SUPPLEMENTAL AGREEMENT NO. 2
CONTRACT FOR ENGINEERING SERVICES
THIS SUPPLEMENTAL AGREEMENT to contract for engineering services is made by and
between the City of Round Rock, hereinafter called the "City", and Carter-Burgess, Inc.,
hereinafter called the "Engineer", and becomes effective when fully executed by both parties.
WITNESSETH
WHEREAS, the City and the Engineer executed a contract on the 23`d day of March 2000
concerning the design of a four-lane divided section on US 79 from FM 1460 to CR 195 to
include bridge design at Arterial A; and,
WHEREAS, Article 2, Scope of Services To Be Provided by Engineer, as amended, establishes
engineering services to be performed in fulfillment of the Contract; and,
WHEREAS, Article 4. Compensation, as amended, limits the maximum amount payable for the
contract to $556,300; and,
WHEREAS, it has become necessary to further amend the contract;
AGREEMENT
NOW THEREFORE, premises considered, the City and the Engineer agree that said contract is
amended as follows:
I. The Engineer will be performing additional work concerning the development of plans
and specification for the additional illumination of US 79 from IH-35 to CR 122,
excluding those sections already developed for illumination in this project, as shown in
Exhibit B.
H. The maximum amount payable of the contract is increased by$68,021.00, as shown in
Exhibit D, to $624,321.00.

LIMITS: From IH 35 to CR 122
COUNTY: Williamson
Project limits were extended from west of FM 1460 to IH 35. As a result, Carter& Burgess, Inc.,
herein after called the ENGINEER, shall provide the following additional services:
The extension was necessitated by the City's request to provide continuous illumination from
IH 35 to the extreme eastern limits of the existing project. This will require additional survey
work from IH 35 to FM 1460. This control and design survey work is outlined in Exhibit"D",
Survey Estimate.
Additional illumination design will be provided from IH 35 to Harrell Parkway and from just
west of Chandler Branch to CR 122.

ITEM: *15.F.9. Consider a resolution authorizing the Mayor to execute Supplemental
Agreement No. 2 to the Contract for Engineering Services with Carter
& Burgess, Inc.for the preparation of plans, specifications, and
estimates for 1.5 miles of additional illumination of US 79 from CR
195 to FM 1460. This Supplemental Agreement provides for the
development of plans and specifications for the construction of
continuous roadway lighting on US 79 from IH 35 to CR 122 at a cost
$68,021.00.

History: The original contract was approved on March 23, 2000, by council by resolution no.
R-00-03-23-13A4 for preparation of plans, specifications, and estimates for 1.5 miles
of US 79 from County Road 195 to FM 1460. Supplemental Agreement No. 1 that
extended the contract to December 31, 2002 and modified the Scope of Work to
extend the project limits to 1400 feet west of FM 1460 was approved at the June 28"',
2001 council meeting. Supplemental Agreement No. 2 is in the amount of
$68,021.00 and will change the scope of services to include additional work
necessitated by the request for additional continuous illumination and extension of
the project limits. This will bring the total cost of the contract to $624,321.00.
