THE COUNTY OF TRAVIS
THIS INTERLOCAL AGREEMENT IS MADE BY AND BETWEEN the State of
Texas, acting through the Texas Department of Transportation (State), the Capital
Metropolitan Transportation Authority (Capital Metro), the Capital Metropolitan
Planning Organization (CAMPO), The Capital Area Rural Transportation System
(CARTS), the City of Austin, the City of Cedar Park, the City of Leander, and the City of
Pflugerville, acting by and through its duly authorized officials, hereinafter referred to
collectively as the "Parties ".
WITNESSETH
WHEREAS, the Transportation Equity Act for the 21 Century (TEA -21) codified under
Title 23 U.S.C. Section 101 et seq., establishes the National Intermodal Transportation
System as economically efficient and environmentally sound, provides the foundation for
the nation to compete in the global economy, and moves people and goods in an energy
efficient manner; and
WHEREAS, Title 23 U.S.C. Section 133 establishes that Surface Transportation
Programs should be developed and implemented by the States' Transportation Agencies;
and
WHEREAS, Title 23 U.S.C. Section 134 establishes that Metropolitan Planning
Organizations (MPOs) and the States' Transportation Agencies will develop
transportation plans and programs for urbanized areas of the state; and
WHEREAS, Transportation Code Section 201.103 and Transportation Code Chapter 221
authorized the State to layout, construct, maintain, and operate a system of streets, roads,
and highways that comprise the State Highway System; and
WHEREAS, Chapter 791 of the Texas Government Code authorizes local governments
to contract with each other and with a state agency to provide governmental functions or
services; and
WHEREAS, Capital Metro is a body corporate and politic organized and existing
pursuant to Chapter 451 of the Texas Transportation Code § 791.003(4) (A); and
WHEREAS, CARTS is a rural transit district pursuant to Section 458.001, et seq. of the
Texas Transportation Code and a political subdivision of the State of Texas; and
WHEREAS, the City of Austin, the City of Cedar Park, the City of Georgetown, the City
of Leander, the City of Pflugerville, and the City of Round Rock, are municipal
corporations and local governments as defined in Government Code § 791.003(4) (A);
and
WHEREAS, the State, Capital Metro, CARTS, the City of Austin, the City of Cedar
Park, the City of Georgetown, the City of Leander, the City of Pflugerville, and the City
of Round Rock all have the authority to perform planning activities related to
transportation management within their respective jurisdictional areas; and
WHEREAS, in June 2000 CAMPO, the local MPO, adopted a long -range transportation
plan which contains major elements of a regional HOV System, including proposed HOV
facilities for IH -35, Loop 1, and U.S. 183, and accommodation for future HOV facilities
on other major highways; and
WHEREAS, the Parties are of the opinion that regional mobility can be improved
through the implementation of high- occupancy vehicle (HOV) facilities, which increase
the movement of people through congested corridors and intersections by offering travel
time savings, thus encouraging bus transit ridership, carpooling, and vanpooling; and
WHEREAS, a high- occupancy vehicle (HOV) facility is defined as a physical or
operational feature of the transportation infrastructure that provides priority treatment for
high- occupancy vehicles. HOV facilities may take the form of separate lanes on
freeways, arterial streets or exclusive rights -of -way, preferential signalization at
intersections or freeway ramps, and supporting facilities such as park- and -ride lots on
public right -of -way; and
WHEREAS, the Parties believe that the mobility objectives of HOV lanes can be
achieved through a regional, cooperative approach accomplished through coordinated
implementation of HOV facilities; and
WHEREAS, this regional approach is to be facilitated by a multi- agency HOV Task
Force, which will identify and address issues related to planning, design, construction,
operations, enforcement, and maintenance of HOV facilities, and to which the parties
commit to provide staff resources with the authority to implement the respective policies
of their elected bodies in cooperation with other participating agencies; and
NOW THEREFORE, in consideration of the premises and of the mutual promises and
covenants herein contained, the Parties agree as follows.
ARTICLE 1. AGREEMENT PERIOD
AGREEMENT
This agreement becomes effective when signed by the last party whose signature makes
the agreement fully executed. The Parties consider it to be in full force and in effect for
24 months. Unless the agreement is terminated under the provisions of Article 3, the
agreement will automatically renewed every 24 months.
ARTICLE 2. RESPONSIBILITIES OF PARTIES
ALL Parties agree to participate in the following activities that are related to the state
highway system, as appropriate and as directed by their duly authorized officials:
• Support and promote regional HOV facility planning, development, and
implementation activities;
• Attend regularly scheduled working (Director's Team) meetings of the HOV- related
Major Investment Studies (MIS) and meetings of the Austin HOV Task Force;
• Provide HOV technical support, including research, data collection, analysis,
presentations as appropriate, and provide timely review and comment on reports;
• Participate in a multi- agency public education/involvement effort;
• Promote ridesharing and support the development of HOV facilities through the
incorporation of HOV strategies and policies into short and Long -range transportation
plans;
• Participate in the discussion of subsequent agreements relating to right -of -way
reservation, project management and financial participation in HOV development
phases, including but not limited to planning, design, construction, operation,
maintenance, monitoring, and enforcement of HOV facilities;
• Identify and plan local land use and development policies that support HOV facilities
and enhance their effectiveness;
• Identify and plan supporting facilities, programs, and services that complement HOV
facilities and enhance their utilization, including but not limited to
• Coordination with major employers to promote ridesharing
♦ Park- and -ride lots
♦ Express bus service
• Parking ordinances that encourage ridesharing
• Arterial street HOV treatments that connect freeway HOV lanes to major trip
generators, or that address localized congestion; and
♦ Support schedules, established milestones and critical paths compiled by the HOV
Task Force for all activities listed above, monitor progress of those activities, assist in
the resolution of schedule delays, and participate in the development of a Quarterly
Progress Report.
ARTICLE 3. TERMINATION
This agreement may be terminated under the following conditions:
♦ by mutual written consent and agreement of all Parties,
• by any Party with thirty (30) days written notice, or
• by any Party, upon the failure of any other Party to fulfill the obligations as set forth
in this agreement.
ARTICLE 4. RESPONSIBILITIES OF THE PARTIES
Each of the Parties is responsible for its own acts and deeds and for those of its agents or
employees during the performance of the work under this agreement.
ARTICLE 5. SOLE AGREEMENT
In the event the terms of the agreement are in conflict with the provisions of any other
existing agreements between the Parties, the latest agreement shall take precedence over
the other agreements.
ARTICLE 6. SUCCESSORS AND ASSIGNS
The Parties bind themselves, their successors, executors, assigns, and administrators to
the other Parties to this agreement and to the successors, executors, assigns, and
administrators of such other Parties in respect to all covenants of this agreement to the
extent allowed by state law.
ARTICLE 7. AMENDMENTS
By mutual written consent of the Parties, the terms and conditions of this agreement may
be amended prior to the expiration of this agreement, including the addition of new
Parties to the agreement.
ARTICLE 8. SIGNATORY WARRANTY
IN WITNESS WHEREOF, THE STATE AND THE PARTIES have executed
duplicate counterparts effectuating this agreement.

the orders, established policies, or work programs heretofore approved and authorized by

I don't have Round Rock. We (TTI and TxDOT) never received a response from Tom
Word regarding the ILA so we proceeded without Round Rock as part of the agreement.
What I have are the 10 originals signed by the other entities. I'm going to talk to Patsy
Warren (contracts) at TxDOT and see how we can get this fixed. We may just have to do
an amendment to add Round Rock or we may be able to just re -print the first page where
the entities are listed and then add you to the signature page. Who signed the copy that
you have? Does it say draft at the top? I'm thinking maybe that's where the confusion
came in. There were lots of drafts in circulation at one time.

ARTICLE 4. RESPONSIBILITIES OF THE PARTIES
Each of the Parties is responsible for its own acts and deeds and for those of its agents or
employees during the performance of the work under this agreement.
ARTICLE 5. SOLE AGREEMENT
In the event the terms of the agreement are in conflict with the provisions of any other
existing agreements between the Parties, the latest agreement shall take precedence over
the other agreements.
ARTICLE 6. SUCCESSORS AND ASSIGNS
The Parties bind themselves, their successors, executors, assigns, and administrators to
the other Parties to this agreement and to the successors, executors, assigns, and
administrators of such other Parties in respect to all covenants of this agreement to the
extent allowed by state law.
ARTICLE 7. AMENDMENTS
By mutual written consent of the Parties, the terms and conditions of this agreement may
be amended prior to the expiration of this agreement, including the addition of new
Parties to the agreement.
ARTICLE 8. SIGNATORY WARRANTY
IN WITNESS WHEREOF, THE STATE AND THE PARTIES have executed
duplicate counterparts effectuating this agreement.

the orders, established policies, or work programs heretofore approved and authorized by
the Texas Transportation Commission.

ITEM: 10.B.3. Consider a resolution authorizing the Mayor to execute an
Interlocal Agreement for the Development of a Regional High -
Occupancy Vehicle (HOT) Facility System with the State of Texas,
acting through the Texas Department of Transportation, the
Capital Metropolitan Transportation Authority, the Capital
Metropolitan Planning Organization, the Capital Area Rural
Transportation System, the City of Austin, the City of Cedar Park,
the City of Georgetown, the City of Leander, and the City of
Pflugerville. The proposed Interlocal Agreement provides for the
establishment of an HOV task force and indicates Round Rock's
agreement to participate in the planning process. Round Rock's
participation in any actual HOV construction and operation will be
established by future agreements.

History: The congestion on IH 35, Loop 1, and US 183 in the Central Texas Region is
growing faster than capacity can be added to the roadway systems. Therefore,
every strategy to improve the capacity and efficiency of the corridors must be
evaluated and considered. We believe that regional mobility can be improved
through the implementation of high- occupancy vehicle (HOV) facilities. To this
end, the establishment of a multi- agency HOV task force is being proposed to
examine the implementation of HOV facilities in the Central Texas Region.
Funding: Staff time only at this time estimated at 8 hours per month.

Impact: This project will tax already busy City staff. However, it is essential for Round
Rock to play a role in the planning of HOV facilities as they will significantly
impact our transportation facilities, and potentially also impact land use in the
corridors where HOV exists.
Benefit: Potential for developing improved mobility in the Central Texas Region,
including Round Rock citizens.
Public Comment: Opportunities for public comment will be provided throughout the
project development process.
